QUESTION PRESENTED Does the Veterans Claims Assistance Act of 2000 apply to claims by states regarding the construction, recognition, and payment of per diem to State homes? HELD: The provisions of the VCAA requiring VA to provide notice of any information or any medical or lay evidence necessary to substantiate the claim, and the duty to assist a claimant in obtaining evidence necessary to substantiate a claim, are not applicable to a claim by a state regarding State home construction, recognition, and payment of per diem. |
