IN fact I do have 100% + 70% schedular for housebound, BUT.. Aid and attendance at even the L rate is much higher than the housebound rate at (s)...
I think I get 3440 or close to it... with a L 1/2 rating... please do not confuse schedular or % ratings with SMC ratings, look up the smc ratings under the smc table directly below the compensation rate table. They start at (k) and go up to (s) - (s) actually being paid less than (l)... makes perfect sense huh? So again, its a kinda fact dependent thing... and impossible to answer unless we know some specifics about your case. |

I was able to open it. The Va pays for Home health care even if you receive A/A if you qualify. I use there home maker services

There are several things to consider in your question. You say you and your wife are applying for A&A. Is she a veteran, with or without S/C? I assume she is not a veteran. If she is not a veteran, she can be paid $126/mo for her A&A (if you are 100% or SMC). My wife is rated that way as a non veteran spouse. If you are less than 100%, then the spouse A&A is graduated from $38 to the $126 according to your rating. Another thing that a veteran needs to understand about A&A is that there are actually 3 types. 1.) is regular A&A "L" award. The 2nd). is special A&A or "R1". Then the last is higher level, or "R2". Both R1 & R2 you have to show that the A&A is needed for S/C conditions that are not already compensated for... as in your 100% rating. In other words, they have to look at the veteran as if he does not have his 100% rating, and see if he needs A&A then. Naturally, there is an exception, especially if the veteran has an "N1/2 +2k" (maybe N1/2 +3K, I forget which) and above, including the "O" rating and in factual need of A&A. I have a case at the BVA for Aid & Attendance for me & my Wife which we both have the Medicial Opinions to prove. It was turned down by the RO but what else is new? Does one have to have a 100% ( I have a 100% T & P rating) rating & also a 60% rating to qualify for this? Also, could anyone tell me how much this would be worth for me & for my Wife? If I'm right about also needing a 60%er how else could I go about claiming his & hoping to win? Thank U for your time GARY You have to be rated 100% for one problem and have at least a seperate 60% rating just for the housbound compensation. I don't see how you could be rated less for aid and attendance since aid and attendance requires more justification than is needed for the housebound rate. If I am right then I don't see how you would win the claim. But the va always seems to have a rule to get around a rule..... Perhaps Vike 17 could give a better answer.. |
