short list but I would think every attorney who practices at CAVC will be willing and qualified to handle claims that the new law will cover.

I just sent an email to the lawyer listed for Virginia to see if they will be able to assist us vets in limbo at the AMC.

Please let us know what you hear, Josephine. Our CAVC attorney said no attorneys will be allowed to handle cases pending at the AMC. If this changes, many of us would sure like to know it!

I have posted for all in limbo at the AMC my answer from one of the attorney's Berta posted in her topic vets attorneys. Sorry my question is at the bottom and his answer is at the top.



Yes

The Appeals Management Center will in all probability send the case to the
Regional Office in the state that you are located if you retain an attorney
and they are so advised.

So that means if we want to take our chances at the AMC vs. the VARO, we can't have attorney representation. If the AMC doesn't make a decision, but in fact re-remands (for lack of a better term) the claim back to the VARO, at that point we can hire an attorney. Or, we can just hire an attorney, which in that case, the claim goes back to the VARO for sure. Is that correct?

I understood him to say that if we hire him as an attorney, before the AMC makes a decision, then the minute he contacts the AMC that he is representing you, that yes, they will return your file back to your R.O, but we will have fair representation.

That may be the only way that we are ever going to get an answer. I sure don't wish to be at the AMC for two years as hurryupnwait has been.

How long has your husbands claim been at the AMC?

Pete is extremely wise, and I feel, that he doesn't think that we are getting anywhere anyway.

What do you think?

You flatter me but I am giving a personal opinion. I do not think that the AMC is doing the job on helping expedite claims. I may very well be wrong and perhaps it would be better if other Vets and advocates would chip into this discussion.

When it gets down to your claim its still your claim. The best advice I can give you is to give some close look to the pluses and minuses and make an informed decision and than don't look back.

My question for the Board does anyone know of a Veteran who was awarded 100% from the AMC. If it was my claim I would ask a lot of questions before I made a decision that changed the course of my claim.

Just remember that there is more than one way to skin a cat.

The Board sent the remands to the AMC in Ocober 2005.

I imagine that your claim is sitting there waiting for a piece of paper that they already have.

I was told that if it is in the overflow, it is still being worked on.

As I told Hurryupnwait, call Ms Dunlap Supervisor of Development and see what they need and fax it personally to her, so that she can log it in.

It has been there too long.

Vaf - Including the fax cover sheet The AMC will accept a total of 10 pages to each fax.

What I did , which was easier for me, I typed up my own fax sheet and typed in the blanks.

This is just in case you do not have fax sheets at home. I then saved my copy in documents in the event that I wanted to fax more info later. I used a type set of about 14 to fill up the sheet of paper.

Your local bank will transmit this fax for you, and so will you local employment office. You will receive back a notice that the transmittal was accepted do save this for your records.

Hope this helps you. Mr.Lidel Gingle is also one that I trust to place records in my claims file.

From what I understand a Veteran will be able to hire an attorney after June 20th, 2007 after the VA has made an initial decision. I suspect that many will charge 20% of any retro bendeits earned.

If you look at interest lost or loss of use the fee would be reasonable.

20% is very reasonable. SSA benefit attornys, charge 25%.
To be honest, i'm completely amazed that the right to obtain legal council from the begining, has even made it this far. I look foward to it becoming law for all veterans.

For those who may not know...............

that anyone that has at least a printer & flatbed scanner, can use their own computer & modem as a FAX machine. All you need is "Winfax Pro" software.
It sends, recieves, keeps a record of faxes, etc. You don't need to travel anywhere or use fuel. It works with your windows or outlook address books, word, office, etc. You don't have to have another machine on your desk, or have more ink cartriges to fill. Your modem needs to be a FAX modem in order for it to work.
