Full Version: Attorney No Longer Representing Va Claim

I just got off the phone with my attorney's office and was informed that they are no longer handling VA claims. The person I spoke with could only tell me that letters are being sent out, and put me through to the rep's voice mail. I had a NOD filed through these guys back in June, and am wondering what's going to happen with that. Will I have to start the entire process over again with a new rep., like DAV, or can someone pick up where they left off? Really frustrated and confused. Anyone have some insight into this?

Hopefully they will refer you to another attorney or maybe you will have to look for another one.

Your NOD should still be good. Make sure your NOD was filed in timely manner. Look for another lawyer to see if he will pick it up. Are you going for 100%? If so then you have a better chance because this means bigger paycheck for the lawyer if and when he wins. I feared this might happen when the lawyers found out how hard it would be to deal with the VA. The lawyers get a percent if they prevail, so they are going to be damn sure they can win if they take your case. I have a feeling they will cherry pick the best and easiest claims.

Is it an actual attorney's office or a VSO's office ?

Sorry, the 'puter was on the fritz last time I tried to reply to this. But, yes, it was an actual attorney. I called the DVA and they stated that they would not be able to jump into the middle of the NOD claim, but wheb it is over and done, then they would be able to appeal. VA sent me a letter stating that they were trying to get in contact with my last employer. I'm sure it is in regards to TDIU. Am going to send them a copy of my SSD Award Letter. You think that will help in regards to getting TDIU?

Your SSD award letter will be good evidence - especially if it list your currently service connected disabilities as the reason for the award of SSD.
When the SSD award letter also list disabilities that are non- service connected, as reasons for granting your SSD ---- then VA will also take the non-service connected disabilities into consideration in an IU claim and try to use the non-service connected disabilities as a reason to deny (VA) IU, and you may want to be prepared for this.
