Here awhile back I had stated I had written everyone Senator, Congressman, and Rep's and it seems Pete53 was right all that would happen was an explanation off what the VA did on the same denial letter. I swear I'd have a better chance of playing pick-up sticks with my ass cheeks than getting any reasonable response just more lies and incompetence at the highest level. Everyone received the same VA response letter and then sent it to me so I have copies of the same BULL$h- letter the VA responses. No depth to it what so ever, Yes it is POINTLESS, nothing on the evidence they skipped. I haven't worked in 2 1/2 years and the VA stated my injuries would have to be disabling more than 6 weeks at a time to receive a rating of 60% than the 40 I have had for years to be IU but never a mention, the monthly doctor reports stating my disability has lasted more than 2 years. .......................uhgggg

I feel for you, it is time to sit back and devise a new plan of action, let"s see what other ideas come from the board.

Well you just have to keep plugging and not give up. If there is one piece of advise I have as far as claims is keep working on it and perfecting your claim till you win.

I agree with Pete lord knows I have been plugging away at my claim since Oct 2002 I just got a new IMO that was just sent into the VARO that provides a direct SC and a secondary SC for heart disease and hypertension I have been appealing and filing NODs since they denied it in July 2003 I am just to stubborn to quit I had a DAV SO tell me once when I was 50%SC for PTSD that I should just quit and be happy that I was getting that much keep plugging ask Betty she's my hero

Yes, the VA hopes you will just give up. This is how they defeat most vets by wearing them down.

I'm sure I have them (VA) by the short ones, but this is incredible. I'll post 1 of the same 3 replies I got from them today what a Joke, Its like a game of poker and the VA is dealin, and dealing from the bottom of the deck and you get what they show you. I sent these Folks the evidence the VA said I didn't have and a Commanders statement, which by VA law is a credible source stressor point blank. Then the VA makes it sound that they JUST awarded me 40% no mention I had been this way for years with 40% since 1995.

This is what I sent The CONGRESSMAN, SENATORS, REP"s: And this was the response from the VA to them in the letter,. all of them
- Copy of C&P Exam Performed by VA Dr.
- Copy of Company Commanders Letter of combat stressors letter
- List of medications of current medications
- Copies of Evaluation by Dr. Howard Lettner PHD.
- Copies of Evaluation by Quinco
- Copies of VA denial letter.
- My NOD Notice of Denial.

don't sweat these BS letters at all, Rich. If the VA told the elected officials that your claim is up for a DRO review, then they would have to explain what that meant, and then the elected officials would want more information when the review was finished. It is easier for the VA to send the elected dummies a rubber-stamp piece of garbage, than to explain the truth.
Just keep plugging on this one, because several of us that have reviewed your claim feel like you can win this on appeal. Do keep every one of these letters in your file, though. They could possibly come in handy later on down the road.

What a load of sh**.
Politicians are darn sure good at paper pushing, but then they almost beg when it come time for re-election.
I sure hope you get enough evidence to nail these fools to the wall.
Sorry you have to deal with this.
I agree with everyone else tho, if you can hang in there, I think you will be successful at getting your claim approved.
I know as someone said on here before, I will die with a 21-4138 in my hand. The coroner will be like what the $%#$ was this guy doing.

On a serious note - do you have a vet rep? I use the one that is in the actual VARO and especially after reading Larry Scott's 3 part series on VA claims procedures at www.vawatchdog.org, believe if you are going to use a vet rep the ONLY way to go is w/ a group that is physically in the VARO so they can walk to the VA office and see just what is really going on with your claim. I know there is a lot of debate and differing opinions on vet reps so take this for what it is, which is my humble opinion that you need somebody on the groud who can go and look out for your best interests since you aren't getting that from your elected officials.

TS...vet reps can be a big help, or they can be like the one I have at the VARO, who never returns a phone call (he does this to others on this board as well...do not use the DAV in Nashville, TN), or they could be like yoggie's and not even bother to take his feet of the desk when they tell you you don't have a valid claim.
I firmly believe in Jim Strickland's DIY method. I also believe, as Jim says, "no one cares more about your claim that you do." There is more than enough help on this board to navigate the RO. If you have to appeal to the BVA or CAVC, I would suggest getting a lawyer.
