Full Version: Dfas Recoupment Of Severance Pay & Va

I was in involuntarily discharged April 07 from the Navy (Honorable) and was given a half Seperation pay $1243.61 but DFAS Recouped it for SRB in 2/05, so therefore i never received Seperation pay, it is on my DD-214 as paid. I applied for Disability Comp with VA and was Awarded 90% but they said i was paid severance pay from the military so they recouped 9 months of my benefits until it was paid. So i am wondering if this is right and does DFAS keeps records of prior military members LES or SRB recoupments not being paid to me.

Was the total separation pay 1243.91? Is that all you got?

Have you formally filed a NOD on the VA decision?Make sure you tell them that it is shown as paid on your DD 214 and attach a copy of the DD 214-

you sure are not the first vet they screwed up on this way.

one question- are you a lifer?

meaning that did you put in 20 years or more? and maybe this is a CRDP CRSC error?

some questions on dates....you said you were discharged in apr 07 but the pay was taken in 05?
when did you enter the military?
what were the conditions of you SRB?

i was in the USAF for 12 years...was medically discharged, received severance pay and now the VA is recouping all of that pay (a little each month that i will literally be paying the rest of my life) because i now receive disability pay....and it's legal. is this is what is happening to you? if so, yes, they are allowed to do this.

I did 9 years active duty 3 years Army (1997-2000 11B), 6 years Navy (2001-2007 AM). I was diagnosed with Chronic PTSD in 2004 while in the Navy. I had to go to Alcohol Rehab, so i went in 2004. Then in February 2005 I ReEnlisted for a 6year SRB. I was deployed in 2006 and November 2006 i was drinking and talked to by my Master Chief, so i told him the CO is gonna Admin Sep me for Rehab Failure and he said no he's not, well in January 2007 i was told by my CO that i was being Admin Sep for Rehab Failure (code HPD). In April 2007 i was seperated with a Honorable discharge and Half Seperation Pay $ 12,341.61, well 2 weeks after being seperated i called my Finance Dept about my Seperation Pay they said DFAS Cleveland Recouped it for the SRB, i received in February 2005 which i only received $ 8,000 before taxes which came down to $ 5,800. In april 2007 i filed for disability compensation, on January 17, 2008 i was awarded 90% for PTSD SC, but the award said you were paid a seperation payment from the military in the amount of $ 12,341.61 so therefore we will recoup benefit payment until seperation pay is paid in FULL, but i NEVER received a seperation payment DFAS took it. Well in March 2008 i filed for 100% increase in May 2008 i was granted 100% Combined Scheduled Rating, but the VA back paid me to March 2008 they said it was a new claim.

They are authorized to keep the seperation pay even though you did not receive it.

If you feel that DFAS was wrong then your fight is with them as the actions of the VA are authorized.
