Full Version: Possible To Appeal Not Enough Work Credits For Ssdi?

Hi everyone,

First post here. I'm in my 30s and receiving 100% disability compensation from the VA. Prior to that I was receiving SSI.

When I did the SSI/SSDI application I was denied for SSDI based on not having enough work credits. Is it possible to appeal this somehow?

Is it possible to have them base their decision off an earlier age (and therefore less credits required)? In essence saying I was disabled as of such and such a date and therefore unable to work? The only problem is my VA initial application date only goes back 4 years and I don't think that even that date would be sufficient. But, I did have the disability issues and its effect on work before that.

Or, is there any other way to address this?

Any other possibility?

SI and VA compensation. But, I understand you can get both SSDI and VA. So, it would be a fairly big deal.

Yes it is possible to make sure that you appeal based on the actual date you stopped working.

Be sure that SSA is giving you work credits for your active duty military service.

Yes, when did you last work?? How old were you then? SSDI/SSI often lie. You need to appeal decision given by them. You can email me @ vaslayer2002@yahoo.com

One of my favorite hadit vets keeps telling me to file for SSDI. I have the EXACT same set of circumstances to deal with. ~Wings

You should it makes a big difference plus you get Medicare which would solve a lot of your current problems with VA Medicine.

In 1983 when I could no longer work, even part time. I called SS and

the lady refused to take my claim. This was before computers.

I excepted her reply, no questions asked.

In 2002, when my husband filed for SSDI, I ask to file again, the

first day, I was told I was missing a credit.

The next day, I was told that the credit for military had been left

off.

I was eligible to file, but this was some 30 years later.

I went ahead and filed in 2002, but was immediately turned down

because of the many years between my employment and my date of filing.

Yes, Social Security does make costly mistakes on those credits.

I by all means would file and and do not let anyone tell you on the

telephone that you can't.

I wish I had been more persistent some 30 years ago.

It's been 10 years since I was told I was 3 credits shy of eligibility for SSDI. I was awarded SSI, but when my VA Comp was awarded, that SSI payments ceased. When I get a decision on my BVA Remand, I'll commense with social security. I can not fight them all at the same time . . . ~Wings

It is my belief you cannot I know you’re looking for facts but I know too many people who cannot receive SSA disability due to not enough credits and they are very educated and sharp folks I believe if there was a way we'd all know it by now, our friend Hoppy who's 100% P/T is another who did not have enough credits. When I filed the very first thing they checked was that I had enough "credits" to even qualify. SSD is a whole different animal than the VA, it’s all or nothing. They check like hell to find something ridiculous for you to do, not make a living at but "DO". Same thing that happen to Wings, happen to Hoppy.

Its funny how SSA works, when I was still in Florida I saw this Haitian man who looked to be 80y and he was complaining to the SSA clerk that the money he received was not enough to live on, and what she told him I will never forget and when I hear stories like this one, that old man makes me sick (sorry if I offended any of you) but this is what the clerk said, "Sir you have only been in the US for 3 years, you don't have much to complain about you bagged groceries for 2 years of that you have a Medicaid card the $600 you receive is all we can do, you just didn’t work enough in the US to receive more financial assistance you might want to check elsewhere”. He walked away pissed as if he had just been cheated and screwed big time. He I am 3 years later busted my ass my whole life and hear stories like I’m hearing now and I see that old man collecting 1000X more than he ever put in and you have soldiers that are raped, blown up, maimed, and scares of serving that has left them unable to work that has put more hard time not to mention the homeless. I swear on my children this happen…..People the life boat(US) is full we can no longer afford to take on these people when we can’t take care of our own….

No, ssdi is for people who worked and pay s.s.

the other option is ssi, for people without credits., but since you are getting 100% via VA, you are over the 900 dlls line.

Always double check how they calculated the quarters. I know that we found several on Hadit 10 years ago who did not get the quarter credit due for military service. Its a yes or no question.

The other thing is to check the paperwork and see if you used the current date as your last work date. If you did you can back it up and possibly requalify. I pray that there is a way. Might not hurt to get a Congress Critter. Also a recap of Social Security Taxes may have evidence that the quarters were earned.
