Attorney received motion for stay. to reach a settlement of my claim. I read the stipulation for remand. BUt it tooo open to delay my claim more. I would like to know if i can send this to someone that can see if it is a potential delay of my claim.

My attorney said that the VA attorney said that he could change it around.

Help! I want another opinion

Can you clarify that?

Maybe it is me- I am on strong antibiotic and can hardly think straight- but- who sent the lawyer a Motion for Stay???

In my formal remand the BVA clearly stated exactly what the VA was supposed to do- to READ my evidence-finally- and then obtain a "new" ( not additional) medical opinion.My IMO knocked down the last VA opinion.This has already been done in a matter of weeks after the AMC got the remand.I dont know the results yet.

Thje remand should clwarly state what the BVA wants the VA (or you) to do.

what I meant was that the BVA should have staed what they wanted the VA to do and also given you opportunity to send in additional evidence or make additional argument-in the remand.

I had no date in which to do this in the BVA remand so I got it to the AMC in 2 weeks.

I also again re-sent my IMOs and also much of the other evidence they never addressed,a list of 34 points they never considered n the medical records, some new evidence I had obtained, and I also made full legal and medical argument for the claim and also fopr the Nehmer factor they have to consider.

It went to a VA examiner days after they got all that so I am glad I didnt wait to send it all.
