On November 27, 2007 I filed claim with the VA for PTSD related to MST, chronic low back pain and Asbestos exposure.

On October 15th, 2008, my claims went to the Rating Board.

On December 2nd, 2008, I flew up to Anchorage, where I had my C&P exam for my low back. It was the most thourough exam I ever had for my back and it was quite interesting, and I learned a lot. Of course the doctor could not tell me what to do.

Below is the IRIS coorespondences.

Question, what can I expect next? What is the time frame? How long can a claim be at the Pre-Determinaiton level before going to Post-Determination? It keeps on dragging out more and more. I am very tired and discouraged, plus due to the additional stresses, my PTSD symptoms are up now also. and I have my crying spels at home.

This is in response to your recent inquiry on December 28, 2008 in regards to the status of our claim.

Our records indicate that your claim is under final review before being sent to the Rating Board for a decision. Please allow the Rating Board up to 90 days to make a decision on your claim.

DJO [b][size="4"][color="#400080"]My response:[/color][/size][/b] This went from the Rating Board back to review? To my understanding, it is the Rating Board that requests C&P exams.
This is not good at all.

The Rating Board can request another exam, but the Pre-Determination Team process all requests for exams. Our records indicate that the exam results have been received.

Once your claim is reviewed for completeness it will be sent to the Rating Board for a rating decision. Once a decision has been given your claim travels to Post Determination for authorization and notification is sent out via US Mail.

It is difficult to determine any time frame at all with the VA.

A few months ago I got a form letter that said "we are still working on your claim blah blah" and never asked for anything from me-

I dont know if this was for the claim I filed in 2003 or the one they got in 2004.

But I never got a proper VCAA letter.

If you supplied the evidence they said they needed in the VCAA letter and responded to the VCAA Election form-this will certainly help you get a proper award.

Were you able to provide them with documented evidence of the MST?
Does your back condition have a strong documented nexus to your service?

Asbestos exposure -these can be very difficult claims to prove-
