Firts I would like to thank the posters and the old guys on here especially the moderators who always have something useful to say. I have been lurking here for the better part of 3 yrs since i decided it was time to retire. for the first time i cant find an anwser to my question if it was previously asked and answered please point to it for me. thanks again for all the help

need to know if anyone else has run into this and if there is a fix or i am just stuck with it.

Requested my C-file be moved from where I retired (fort bragg/winston-salem RO) to cheyenne, WY RO. I than sent a letter to Cheyenne asking for a copy of my C-file. The reply I from Winston-Salem RO was that my file was there and there it would remain (this letter only took them 4 months). I called Cheyenne and they confirmed that the file would not be transfered. My file is apparently an electronic file? So now if i want to see my file i only have to drive 2300 miles.

My C-file only contained my C&P exams nothing i had submitted (my entire SMR was submitted). i have resubmitted my SMR and my NOD (which was cancelled after 5 days i did send it to cheyenne).

Any ideas how to get my file transfered?

Anyone ever hear of the VA just cancelling a NOD? Had i not called i would have been hosed eventually. it was sent certified and like a fool i had the return receipt and was giving them time to do there letters or what ever they need to do. i now have 3 copies of my nod/med records and will call the day i get the green card if i dont get a good anwser i resend.

Your file is at Winston Salem because you participated in the Benefit Delivery at Discharge (BDD)program. They cancelled your NOD at Cheynee because they do not have jurisdiction of the file. Will PM your with more info.

yet the Reg that Carlie (thanks for the info) posted says nothing about not being able to transfer the claim to my home state. I in fact requested its transfer in writing 4 times. in the Reg it states that u can do it on the phone. the 800 number bunnies had told me my claim file was in Cheyenne VARO so it would make sense for me to mail my NOD there. "Cheyenne says they did not cancel my NOD (they state it was forwarded to Winston) and it was done by Winston-Salem because Cheyenne did not have jurisdiction fo the file and could not cancel the NOD".

I am just aghast as to why the VA cant seem to follow the Regs as published.

I don't know how to link web site, but if you go to va.gov you can read up on the BDD program. The regular rules don't apply. BDD is a seperate from the regional office and was established to work claims for individuals transitioning from the military.

Maybe T-Bird will start a forum on the BDD program.

I have read all I can find that the VA puts out and the best I can find is the memo (VA TYPE) that says its more back logged then the normal claims process and they are expanding time limits for finalizing claims.

The BDD program is just a way for the VA to reduce there apparent times in processing claims since even though mine was at the VA for 7 months they show it as being rated in 40 days. They don’t start counting till you’re out. So they can tell congress see we are servicing vets. They should just say we are paying lip service to congress and the American Public and Veteran.

Just another way for the VA to delay, deny and dishonor Veterans service to this great Country.

Hell at 8 Vets a day from suicide and 4 a day from natural causes the time is in the VA's favor. that’s 4380 vets a year.....

Sorry for the negativity expressed in this post I am just very frustrated right now....


And to BOOT on MON I received a C-file that was addressed to me with a cover letter to me but it was a Marines from CT. VA 800# response was just destroy it.
