Much to my surprise today I received this letter from VA.
It states that the new evaluation criteris became effective Oct. 23,2008
and that I maybe re-examined based on the new criteria.
I feel this would certainly allow me to recieve more for TBI than
my current 10 %.
I'm posting a copy of the letter here and feel more vets will be getting the
same letter soon and should all respond.

Amazing how that sent the letter at the end of the month. Put in your claim right away so that you preserve your date of claim.

I have a theory that may be useful. Check the October 23, 2008 edition of the Federal Register by going to their website and see if V.A. published a new regulation on that date pertaining to head injuries.

I'm also surprized they are sending the letter out.

I havn't gotten one and I'm leaning towards not being re-evaluated even though my interpretation of the regs would put me at 100% plus. I asked about it on the forum but no one replied.

Old rating are not supposed to be reduced if the new rating is lower. Does a P&T vet gamble on that for a possible 100+70% rating? Tough to decide untill I see how ratings under the new schedual are handed down.

Most vets should be re-evaluated though.

seems like It was posted that the VA increased the rating for TBI to 40% some time ago.
Does anyone remember?

I think this change in the Schedule for Rating Disabilities applies
to Diagnostic Code 8045.

Do you know my husband was rated in Sept. prior to this change and we have yet to this date to get this letter telling about the change? I would have never know it had we not read it on this forum.
