Im awaiting 90% service connection compensation Award with 5 more condtions on appeal still to BVA.


My claim is expidited, expidted hardship claim been to both raters only snag is proposed Incomptency which waived to get money faster elected to have mother as payee, then will switch back to comptent as soon they cut her retro backpay check.

We then will hand in statement to VA stateing I can Handle my own money and 100% comptent with mother as supervisor, not sure how long to switch back from incomptent to comptent will take.

I had SSD-SSI hearing in July 09 judge still has not ruled will my 90% service connection compensation help or hurt my SSD claim?
If VA is saying im Proposed incomptent would not be to use that as tool with this 90% service connection compensation award to get SSD Judge to decide in my favor grant me SSD proveing even VA says I cant work etc?

Also Does ex % percent at VA help get SSD can get Both how does that work ?

That's a great way to do it if they have declared you incompetent to handle your own financial affairs. I agree why fight the incompetency now when you can go ahead and get the money via your mother and then try to get it changed.

Smart move and shows in itself you are competent. Not like your mother will take your money. At least I know my mother wouldn't.

Furthermore, anything from the VA you can show SSD will help your SSD claim. All the evidence is promulgated to one final decision.

Once VA has adjudicated for you to have a fiduciary then you will have to
apply for competency - a doctor will have to say your are and a field investigator
will probably will most likely pay you a visit to check things out.
I helped a buddy regain competency and it took us about a year going through
a very busy VARO. He had been declared incompetent for about 10 years.

Also, I am not positive on this BUT I think the money you have been receiving from
like social service's to help pay rent and stuff - I have a feeling that when your SSA
benefits get approved - the goobermint will re-coup those funds from you.
Like I said - I'm not positive but be prepared for that too as I have seen it happen
and if they decide to - there is no way around it.

the SSI pays back the 3 years of rent vouchers 1st out of it then SSi and SSD lawyers gets cut and so.

Could I get back my Comptency within like 2-3 monthes mean if they dont think im totally incomptent and understand that only waived being comptent to get money to mother for hardship to speed up, they see im going fine is 2-4 monthes reason able?


Im just wondering how long of delay to get comptency totally restored etc?


Cause when get Money Im moveing near monther which means, I will be changeing to New VA which means 100% all new doctors and that alone to get new doctors set up can take monthes.

If you get SSA benefits you will either get SSI or SSD.

If they have you see a doctor regarding your financial competency take a printout of your bills showing that you pay them on-time and if you have a copy of your credit report (experian, transunion, equifax) take that with you too if that proves you are paying your bills.

My last exam the examiner asked specifically how I pay my bills and I just told him I pay all my bills online and they are automatic every month. I guess that was good enough since he declared me competent.

If win will get SSD However to start to pay off rent vouchers 36 monthes, they give you SSI as well just to start SSI covers rent vouchers cost, and get some left from SSI then they stop you get all SSD backpay minus lawyer fee.


That is what my Lawyer told me, My social worker and Have had friends get SSD and SSI in that way that got both to start to pay of rent vouchers.

Maybe do it differnt its in the agreement Social services has with social secuirty.

Cause they Social service the state are not aloud to touch your SSD money per month even with 3 years backpay they cant touch 1 penny of it.

Only way they get all 36 monthes rent voucher repaid is When get SSI with Higher SSD moneies.

But then SSI stops like 1st to 2nd month you get Money the SSD backpay they stop it when social services signs off they got all their rent voucher money back understand?

So They get all their money back for sure they have agreement between them and social secuirty to award SSI with SSD.

Again You get all backpay for Both

Rent vouchers 36 monthes -Max comes from SSI then get what is left of the SSI -only its why they give you both to start.
SSD money Lawyer cut comes out then get what left for backpay.

then in 1-2 monthes they stop SSI payments to you when social services signs off they got all rent voucher money back understand?

To Add Insult to Injury found out today SSD Case was won with 4 years backpay for that, But like VA Case claim will have to go thru long Comptency Dance, thus Im about to be homeless with my 2 cats as of Saturday.


VA is aware homeless as of Saturday with my 2 cats.

However my case is already expidited, expidted Hardship claim, However due to comptency Circle Jerk I am being Told 60-75 days for my mother to get set up as payee at very Least.

Worst of all have Signed Doctor Note By Primary Care Doctor and Mother that I am 100% comptent and able to handle my own money.

Mothers Note states for last 4 years as Ive Been sick, sicker she deposits money in my bank account monthly and I pay bill with it for other half of Rent, rent vouchers didnt cover etc, cat food, tolietries etc Then from my bank Pay bills online with my bank debit card.

So Does it Make sense why My Primary doctor note and mothers not dont Just get Money realsed asap with my hardship claim, Should they not make me comptent and make this whole process over?

Need some help im so Depressed over about to be homeless even worse then me being homeless what do I do with my 2 cats I love dearly their like my kids to me, I would Die before I would Lose them.
