Under Order of May 24, 2005 this case has been assigned to a panel of the Court for issuance of a precedential opinion!
This might well resolve something that we all want- I have certainly done what I could re: griping to VA to change these unfair regs- they are unconscionably unfair to Blue Water AO vets.
Many veterans and many (probably all of them)vet orgs have griped.Individuals have griped -even a young college student-I think she is child of a AO Blue Water vet griped -also many other non vets have taken issue with these regs by writing to the VA and anyone who would listen.
This would be Wonderful if the CAVC grants this Blue Water vet claim and establishes a positive precedent that we can use.
In the event that the court does not establish a favorable decision I know we -who want these unfair regs changed- will continue to push for that.
I am just overjoyed at this news-dont know how it will turn out at the CAVC but if granted, AO Blue Water veterans will have WON a major battle.
