does this mean that the vso's get a peice of the action if it goes to the bva? If so then they are definitley in bed together.
Until I got to the end of the article, I thought I was reading something by a person completely ignorant of the way the VA works. This whole article is predicated upon the way the VA is supposed to work - not on the way it actually does.
There are a million reasons why hiring lawyers will not work, but then there are over 6 million reasons why we know that the current VA system doesn't work, and never will, until there is a complete change of attitude at the top of the VA.
My own experiences with DAV have taught me that SOs are a waste of time. If you can, you are better off doing it yourself. This guy is many times worse than DAV.

The DAV has fought this Lawyer legislation tooth and nail. Somehow the DAV, has been a screen for the VA while interpreting the law and enforcing their own perspective of the law. If the DAV is so superior why are they so afraid of the competition? The reason, of course, is that DAV representation is crummy by and large. You are better off yourself learing the rules and doing you claim your self by far. I think lawyers would be helpful in getting the highest possible initial rating if they get part of the back pay. There must be an incentive for them to get bigger pay days if they get higher ratings for vets. SSA lawyers get a percentage of the back pay of the client. Why not do the same with the VA except SSA is always a total disability award. There will have to be a way make their a settlement process for them to know that winning is going to put money in their pockets and that the money is available.
There are very few lawyers who do federal workers compensation claims because their clients are usually broke and they cannot get a percentage of any settlement because their is not settlement.

there are a lot of lawyers that do SSD appeals and they are limited to 25% or a max of 5400 and they make a great living at it, setting up the same system for vets in the VA process would not be that hard hell by the time we get approved anyway they would be at the max figure of 5400 anyway if they could shave off 2-3 years of the process it would be worth it

Wally, we've got to learn how/when to use lawyers (if we can convince them to take our claims). I'm thinking right now that I'll proceed with a VSO until things become unreasonable. Then compile a complete C-file and all correcspondence and present it (SELL it) to a qualified VBA Claims attorney to proceed with. Change the POA to the attorney and give the bird to the VSO at that point. Will probably mainly depend on the amount of retro.?.?

From my experience ( If U have a valid claim) get a Lawyer as soon as possible.
Fooled around 7 years by myself was SC at 100% in 18 months with a Lawyer
