jill mitchell cavc lawyer reviewed all information medical ,r/o decisions,drs opinions ect. she got upset after reading some decisions and said how can they deny this? ms mitchell is writing a review of what the decisionsand all evidencefor january 19 th personal hearing in waco.also agreed to take my case to bva if needed.anyones thoughts? best regards chief 313

How is she going to get paid? That is the main question. Is this coming out of your pocket? The good news is that if she is going to get paid via the VA or a percentage of an award then it bodes well for your chances since lawyer don't take cases they can't win unless you are paying them out of your pocket.

Good work. Now you got real representaton. Better to pay an atty fee now than 20 years of denials without back pay or hireing a lawyer latter and having to pay all that retro pay to the lawyer. Once you win your case your comp is free and clear with a lawyer. Without a lawyer, Well as she stated. In my experience with a few vets with lawyers at the CAVC- if they win the case, it goes back to the RO for actual award and retro and at that time the VA withholds the lawyers fee and gives the vet time to respond to the withheld amount.

I wish they would decide on a fee agreement case I helped with.

The VA has 5 conditions for payment and the vet's lawyer did not satisfy all conditions so we filed a NOD on the fee decision and pointed out exactly why the fee VA wanted to pay was wrong per VA case law and regs- which we attached.

Have you searched at CAVC for any of Ms. Mitchell's work there?

Jill Mitchell is a foxy lawyer from Austin (?) who does veteran’s law cases exclusively. Actually, she’s a soccer mom who practices out of her kitchen (don’t tell any of this, since I know her and periodically have to deal with her. She’s not as experienced as some, but she’s competent and committed. And she is not one who drops you after a remand from the court but will follow up at the RO.
