    • A bit about Tbird and HadIt.com for those who've asked...

      The following is on my About page, but some have been asking how this all happened. So here is my little story. Tbird US Navy 1983 – 1990 E-6 HadIt.com the website domain registered Jan 20, 1997 the domain is registered and paid for through Jan 21, 2023 at which time I plan to register it for another 15 years Lord willing and the creek don't rise. I guess the best place to start is Jan 1991; I had gotten out of the navy Dec 1990. At my separation seminar, there was a DAV rep Jim Milton he told us to bring our medical records in and he would look through them for us and let us know if we should file a claim with the VA. Well, bless his heart, he opened my medical file, reads the first insert, looks me straight in the eye, and says you will be 50% for the rest of your life and he would file the claim for me. 50% was for surgery I had in the service. True to his word he met with me and talked with me for a long time filled out my paper work and urged me to file for PTSD. I would not file the PTSD claim, nor even discuss it. By Feb 1991 I had moved to the San Francisco bay area and was staying at a friends apartment and pretty much I was just a puddle. In desperation one night I called suicide hot line, I had no job, no idea about going to the VA. They talked with me for a long time and explained to me that I could go to the local VA hospital even if I did not have insurance. Now, I know what you are thinking if I was 50% why didn't I just go to the VA in the first place, two reasons 1, this was Feb 1991 and the 50% didn't come till May and 2, even if it had come through it is unlikely that I would have had the mental acuity at the time to put the two together. I relate this here because it is where so many of our brothers and sisters are coming from, perhaps where you started. Fuzzy and unsure, in pain and sometimes homeless they come to the VA hospital for help. And that is where I ended up. Up to the pysch ward I went, blah, blah, blah, a few days later I was released with a promise of a call from the out patient program, which I would soon be entering. Blah, blah, blah, after many missed communications, and no call backs I was at the Day Hospital everyday M-F. And this brothers and sisters is where I began to learn and formulate my plan for HadIt.com. Veterans, veterans everywhere…I spent a year in the day hospital and about another year at a sheltered workshop before I got back on my feet. So I just talked to veterans everyday waiting for appointments, waiting for prescriptions, waiting for a vet rep and I started to learn the system. While in the navy I was data analyst and had to learn a 5 volume manual and just about anything you were suppose to do was in that manual. So I figured there must be a manual on how to do a VA claim or at the very least regulations. So I found out about the Code of Federal Regulations, United States Code, Veterans Affairs Manuals and so on and so forth. Of course this was 1991/1992 I was living in a tiny studio apartment in a particularly bad neighborhood, working in a sheltered workshop making a nickel per envelope I stuffed throw in PTSD and you will see that it was a difficult task for me to get somewhere where they had copies of these, let alone that they would let me look at. And there was so much knowledge around me, it was like the gold rush in those days, I could just sit on a bench a veteran would sit down next to me a little conversation later I had another nugget, I made copious notes. Phone numbers to call, ask for this guy or that guy he'll give you the straight scoop and they'd slip me a piece of paper with a number on it. You want to read this regulation or that one and another slip of paper into my hand. I spent a lot of time on those benches watching the squirrels they gathered their nuts and I gathered mine :) So I'm thinking I could put a little handbook together print it out and hand it out at the VA. Or perhaps fliers. Still formulating, time goes by, 1994/1995 I am being treated for PTSD regularly and doing and feeling much better and I go to work for a company as a marketing systems analyst and I discover the internet. Well let me tell you that was perhaps one of the most significant life changing events I have ever experienced. And I might add finally a positive one :) It seemed only natural to me that surely there must be a website that contained all the knowledge I wanted, well as it turned out not so much, lots of stuff but I wanted to get straight to the claims information and there was a lot of stuff to wade through to get to it. So taking my lesson from the squirrels earlier I started to gather, gather, gather…and learn HTML and work as a marketing systems analyst and work my claim. 1996/1997 major PTSD cork blows and unemployed. Working my claim, working the website. 20 Jan 1997 register HadIt.com domain name right after getting off the phone with the VA and saying I've had it with this. As fate would have it the old DAV board goes down just as mine opens up and folks start to wander in. So HadIt.com has two main components the website which supports the discussion board with links, articles, research resources etc. The website starts to grow, I can't tell you how many times I had to switch servers for space and features. I continue on a downward trend and in 1998 ended up back home in St Louis living in my sisters basement in therapy and working it, I swear I would have swung a dead chicken around my head at midnight naked if I thought it would have helped. The website continued to do great during this time, I just stayed in the basement bought new software, new books, and learned how to make things work and I continued to use this knowledge to make HadIt.com better. My 100% finally came through from the VA and I had a friend who is an advocate who helped me thru my SSDI claim, he was literally at my side thru the entire process and that came through for me. My therapist and sister continued to try and get me to leave the basement, but to no avail. At some point in 1998 or 1999 I put a counter on the website and was shocked to discover how many visitors we were getting. Time goes by my sister gets married and I move from the basement to the upstairs, there is much celebration that Aunt T is living in the light again. More time goes by and I settle into my life in St Louis and spend more time on the site trying new things, finding more information. 2003 I buy my own home VA loan. For years now I have just considered HadIt.com my job and I get up every morning go to the office and work for several hours, take an afternoon break and see where the rest of day takes me. I have a place in the office to use the computer and a comfortable to place to read journals and articles and take notes. Blah, blah, blah so that is my story and HadIt.com's intertwined.

They stated that they made a mistake when they awarded me on my hip and were severing it.

The above statement sounds to me like the VA has called an error on themselves

regarding the Rating Decision that granted SC for your hip.

If you actually do have the hip disability and the medical evidence for it, I would try

to keep it SC'd.

It would be good to re-look at the Rating decision that granted SC for your hip.

You can request a VARO hearing on this issue AND request no reduction in compensation

take place prior to the hearing, I suggest you do this in writing and keep a copy of it

for your records.

It is my goal to get in my IME and request a reconsideration before my 60 day deadline. I have been told if I can accomplish this is should stop the severance of my hip rating and get my other Secondary S/C conditions rated and get my TDUI. Is this still how I should proceed. I have already scheduled the IME for this Saturday in Bethesda, Maryland. Please let me know if this sounds correct to everyone. Just want ot make sure. Should I do what you say below also in the interim? Just curious. Please let me know so I can do that asap.

Kentucky has introduced a new Military Family Assistance Trust Fund to provide assistance to all Kentucky Home of Record military members and dependents who are facing undue hardships caused by deployments outside of the United States.

Contact your nearest Kentucky Dept. of Veterans' Affairs Representative for more information.

OK now my next question is this. I still have about two weeks before my 60 days is up on severing my hip SC. I have my IMO/IME so what are the proper steps now? Write a letter stating I want a reconsidering on my HIP disability before it is severed, On my overall claim? Or should I just contact my DAV rep and let him guide me through this and do what needs to be done for me? Let me know guys. Thanks again. I am almost in Phase 2 thanks to everyone on this Forum! I have faith which I would not have had if not for everyone here. I look forward to everyone's guidance.

If you have paperwork put it in the hands of the VA yourself and get date stamped copies and then give copies to your DAV guy. If DAV misplaces your paperwork and request for not severing your hip SC your claim will die. Two weeks is too short a time for screw ups to happen.

I thought that that would be what I needed to do. Just to make sure that I am doing everything I need to do I have listed it below. Please let me know if I have everything covered. Thanks again everyone.

1. Submit a written letter asking for a "reconsideration" based on new medical evidence (The IME/IMO). In that letter ask for a VARO hearing and request that my compensation for my hip not be severed until the hearing takes place.

2. Fill out a new claim based on the IME/IMO for new medical conditions which the VA also requested I put in for a few months ago since it was not part of this claim.

3. Should I fill out the TDUI form that they keep requesting and send it to? MY DAV rep told me not to as I can do that after the claim has been awarded.

4. Send the letter, IMO/IME, New Claim Request, and possibly the TDUI form if I need to do so.

Please let me know if this is everything I need to do based on the current situation. Thanks to everyone for your continued advice.

Letter requesting reconsideration, IME/IMO, and additional conditions letter has been submitted. I will wait to see what they say next. Thanks to everyone who assisted me in my claim efforts. I will keep everyone posted on things as they unfold.

Just when you thought it could not get more convoluted here is my recent update. I have given a quick history of recent events so everyone knows were I am at currently and what I have done recently. As stated below I was denied TDUI/100 % due to a bad evaluation. They VA also stated that they had made a mistake last year when they granted me service connection for my right hip and that they were going to sever that compensation within 60 days. Based on advice received on this forum I followed the path I needed to in response to the bad evaluation and denial/compensation severance. Listed below is what I did and what they responded with. I welcome any and all advice on this current turn of events and I am currently having my DAV rep check into it as well.

1. I obtained an IMO from a reputable Physician.

2. I submitted that IMO before the 60 day deadline for my right hip severance with a letter which stated the following

a. I requested a reconsideration based on new medical evidence (IMO) for overall claim including Back and hips which are clearly covered in the IMO.

b. I requested that my right hip percentage not be severed until a complete review of my claim and new medical evidence be completed

c. I submitted additional conditions which were included in the IMO and requested that they also be considered with this claim as they are related to my overall condition.

VA response was as follows: ( Keep in mind they already stated that they had made a mistake when granting me my right hip S/C last year and based on the bad evaluation, they were going to sever it.)

1. They said that they were working on my claim for my feet? already rated!

2. They also said that they were working on my claim for new conditions ( the conditions I added that were included in the IMO)

3. They also said that they had denied me left hip and back on this claim previously and that I had one year to appeal that decision as I have not submitted any new evidence to refute their decision??

It is obvious to me that they did not read my letter nor did they review my IMO. If they had they would have already known that I submitted new evidence that refuted the bad evaluation entirely. All that I can figure is that they are not truly reviewing the new information I submitted at all. It looks to me like they are just pushing out letters to delay and deprive me of what is obvious and service connected! Has anyone else had this same issue? Were as you submitted an IMO asking for a reconsideration and they totally ignored it without even reviewing it? I wonder if this is some kind of approach they use to get us to give up or something by frustrating us? Is this why the VA is being questioned by congress and senate because 80 % of all VA claims that are denied at the regional office and then granted on appeal or before a board? My DAV rep is currently checking into this to find out what they are doing here. He is also bewildered by this approach as he reviewed, date stamped, and submitted my reconsideration package. Once again a clear cut black and white claim is in limbo. I welcome any/all advice on this issue. This forum is my guiding light and without it I would be lost. I wonder if this has happened to anyone else? What did you do in response? What should I do in response. I will update my post when I hear from my DAV rep on this matter later today. Thanks to everyone in advance who responds and/or provided me guidance/advice.

Did the doctor follow the IMO criteria in the IMO form here?

Did he/she state that these conditions prevent you from working?

AN IMO at this point might as well cover the TDIU issue too.

It was all more than covered in the IMO. The IMO was in the correct format and even included VA law. Interestingly enough my DAV rep inquired and come to find out what I had originally thought was correct. The new information was not even reviewed at all. Just a letter stating what I shared below. I had a feeling that the information and claim was not reviewed completely the first time as there was clear evidence in my medical records and it sure was not this time when I submitted the IMO! This has been acknowledge to a point by the VA and it took an argument in writing from my DAV rep to get it back on the table for a complete review as it was obvious that the information was not reviewed. It has been requested in writing that it be reviewed and re-opened and if they refuse than He has requested a hearing immediately! I will keep everyone posted on what occurs next. Thanks to everyone for their continued support.

Sure sounds to me like someone (ummm, like your DAV rep) is just blowing smoke your way.

1) a review is one thing

2) a re-open is totally different and will require new & material evidence,if your most recent

IMO/IME evidence is considered in the review, then it will have already been considered

and you will be required to get even more - new & material evidence to re-open.

This is a friggen joke - as immediately will not be anytime in the near future,

you claim will get in a long line just like any other, he has no special powers or pull.

I'm posting the truth here for you to help lower you level of disappointment as I fully support

VBA claimants knowing the truth without holding back any punches.

I really appreciate the truth. I have learned throughout this process not to expect anything and that disappointment goes with the process. I will just have to wait and see what transpires and what the VA comes back with in response to the DAV reps letter, which I received a copy of today. It is clear though that they did not review the IMO I submitted as evidence in my request for a "reconsideration". An IMO I could not afford and a trip I was in no shape to take. I have learned as all of us have that there is no clear path here and that bad news is to be expected in most situations. All I can do is continue to stay the course and keep the faith that eventually the truth and right will prevail. I am grateful to have the wonderful folks at the DAV assisting me in this matter but I do understand what they are dealing with also. Maybe someday I can use what I am currently going through to help other veterans as you guys have and are helping me. Thanks again for the support and I will keep you posted on what transpires next.

My claim has been reopened and is being reviewed/reconsidered for compensation based on new medical evidence I submitted. I will keep everyone posted on how things transpire. Looks like they are finally looking at it thanks to my DAV rep.

Great. This is why we MUST carefully read the evidence list in a SOC carefully and then- even if they do acknowledge the evidence-they must opine on it in the narrative.

If the VA doesn't list something probative (such as an IMO) as evidence, this means they lost it, destroyed t, ignored it, or are too lazy to read it.

Well the consensus is "To lazy to read it". I guess by immediately pushing out letters of denial without even looking at the case, VA medical Records and Doctors opinions, and new evidence submitted such as my IMO they get it off their desk eventually and on to someone elses. It was obvious to everybody who has seen reviewed my case that they did not look at my claim for first time other than the BAD C &P exam. It is more clear to me everyday that the regional offices are so overworked that they push out letters without reviewing anything most of the time. This is probably why most claims are awarded on appeal. Is there no checks and balances for these claims people at the regional level? I mean to say if they just push out letters of denial without review and then it get's appealed and goes to the next level, do they not start to look at the reviewer at the regional office as a problem or can he just continue to operate by not reviewing the claims like he should?? My guess is there is no fallout from what they do regionally and that is causing allot of delays for Veterans in need of compensation for service connected injuries like myself? At any rate I now await my next decision and pray that finally someone reviews it correctly. The funny part is the individual that has had my claim twice and denied it twice now said that someone else would be reviewing my claim above him?? Once again pushing it off with no obvious repercussions? That is surely part of the broken system if regional offices are denying claims as they are overworked? Either they need to change the way claims are processed or they need to add additional resources to handle our claims. Either way there most certainly should be some type of tracking throughout the whole process on the VA's part to insure that if certain people at the regional office and even Doctors who do C & P exams which continually deny and or delay obvious claims/awards that are truly black and white, then those individuals need to be replaced or taken out of the process in the future. Just like any other business right? If you continually do not perform your job duties as you are supposed to then you are either demoted, or written up until you are terminated! Anyway that is me venting on the whole monstrousity that is the VA claims process. It would just about guarantee that if they started looking at all these claims denied regionally that are won on appeal (I think the percentage is about 80%) Then the would most likely find were most of the issues exist. Why even have a regional office other than to delay and or deny claims? Has anybody had any luck using your senators and congressman on your claim when stalled or handled incorrectly? Just curious. I have been told that now I can most likely expect a low ball award as generally that is what normally happens in my type of situation. Anybody have any experiences with that type of approach from the VA? I am just wandering as I may need to prepare myself just in case. In closing I just saw a neurosurgeon and I was told the same thing. My back is surgically unrepairable and will only get worse along with my other issues. Although I have seen and received many medical opinions and they are all the same so now I cannot help but wonder how long I will be able to stand and/or walk before I cannot any longer? I guess I am pretty down right now but will my days on two feet and a cane outlast my VA claims process? Guess all I can do now is keep the faith and hope that the right thing occurs this time. Well I got my letter today and the regional office once again denied everything and severed my right hip award. Although I had an IMO from a reputable Doctor who has extensive knowledge of the VA and congressinal inquires by my Senator and Congressman, they still denied me. Their reasoning was another straigth forward excuse/push off. They essentially said that they were taking the opinion of the Doctor that performed my C and P exam (the Doctor who essentially did not perform the exam right, was extremely biased and even made fun of my cane, pulled the muscles in my ribs, and gave opinions using support from old literature) over My IMO Doctor who used recent credible new medical studies to support his. It just appears that is is another push off from the VA using standard boiler plate to keep from doing any true work. I was under the opinion that if a private Doctor who is credible and peforms an examination and gives an IMO conflicts with the VA examiner, that the Veteran get's the benefit of the doubt? Or is that just when you go to a VA board hearing on appeal?? At any rate I am confused and in a dark place over this mess. I guess it is not enough that I am almost housebound due to my conditions and that another Doctor refuted the VA Doctor's biased opinions and gave black and white Evidence to support his opinion. Any ideas on what my next steps are? Should I now appeal since they blew me and my IMO/Doctor off again on my reconsideration? Or is there other steps I need to take now? At any rate I will be sharing my response with my DAV rep and my IMO Doctor. I guess they will keep denying everyone until you appeal and go before a board?? That seems to be the process at this point to me regardless of an IMO from a credible Doctor. I seek your guidance once again my fellow Veterans as I am at a loss. Sometimes I just feel that I am cursed with bad luck not only because of this but also my medical issues. Issues directly caused by my Service Connected Injuries which is clearly stated in my VA medical records and in my IMO. I was under the impression that if a private Doctor who is credible and performs an examination and gives an IMO that conflicts with the VA examiner, that the Veteran get's the benefit of the doubt? Or is that just when you go to a VA board hearing on appeal?? At any rate I am confused and in a dark place over this mess. Well I am still trying to decide what to do about my denial. I have so many appointments lately that I have not had time to think about it much really. On one hand I know I need to write a NOD but I am wondering if I get yet another IMO will that be considered once again as new evidence and will that allow me to ask for a reconsideration once again? I wonder since the last one IMO I submitted was to no avail. If anyone can give me some advice here I would really appreciate it. NOD, reconsideration with another IMO, or something other than that. What is the best approach for me now. I welcome any and all advice at this point as I need direction. Thanks to everyone in advance who responds to me. I really appreciate it.
