Index

To anyone visiting....

This is a work in progress. It will take a little while since I have a WHOLE BUNCH to input.

Keep checking back to see what is happening.

I will be posting an Index so specific letters should be easier to find.

Have patience. :)

Tbird and I are working in tandem to post these letters. Sometimes there will be no links OR the document because we are each doing different aspects to create a whole.

Please keep checking back and don't worry if it isn't there. If it is posted as a topic, eventually it will be available.

This includes the index also.

IF A TOPIC HAS THE WORDS "WORK IN PROGRESS" IN THE TITLE, THEN THAT TOPIC IS NOT FUNCTIONING YET.

WHEN THE TOPIC IS VIABLE, THOSE WORDS WILL DISAPPEAR.

:)

Just had a thought......

Until these letters in this forum are up and running, if you really need to read them, all but two minor ones are posted on the Veterans Benefits Network site. It, too, has an index with where located in the topic.

Here's the topic:

http://vets.yuku.com/topic/48610

I wish you good journey.

IT'S DONE!

Tbird has worked her MAGIC! She has turned, for the most part, the letters/directives/whatevers into PDF files. (There are some that a pdf might not be necessary.)

This means that you, the viewer, can download, print out, copy or whatever necessary to use for your own personal viewing.

SHE DID A FANTASTIC JOB!

As of now, the Index is linked to the individual topics.

ANYWAY, enjoy and may it help you on your journey through the 'undiscover'd country.'

Index

The following is the index with links to the various Training and Fast Letters plus a few miscellaneous. These letters are not necessarily in the original formatting. I have tried to present them in an easy-to-read form instead of some forms as originally presented. Some of the paragraphs were WAAAAYYY too long. lol - HadIt.com Member fanaticbooks

Something to be aware....

Some of these letters may be rescinded, outdated, or otherwise no longer viable. I have still included them because sometimes they provide additional insight or just plain more information than the newest version.

Use them wisely.

The oldest letters will display at the bottom with the latest letters displayed at the top, all in sequential numbers.

Coding of the letters...
FL = Fast Letter
TL = Training Letter
First two numbers = last two digits of year of origin

WOW-this is GREAT- Thank you Tbird and Fantasticbooks for all the work you both did here!!!!

The first one I read regarded the Hupp decisions for survivors claims.

VA failed to address this important court decision and even the proper VCAA format for my 2003 claim-

my evidence rendered their legal VCAA error moot but still many widows, getting the same illegal VCAA letter I got, would not have any idea of what to send VA as evidence.

Every time they fail to apply these fast letters to claims they should be applied to -they are knowingly setting the stage for a denial.

This list is Wonderful!

I have sent them their own fast letters as evidence from time to time.

I am sure the Bradley Fast letter is here- another VERY important one.

(TDIU plus 60 % additional independent disability equals SMC.)

For this TL & FL Topic endeavor, my most grateful appreciation to Tbird and fanaticbooks.

It is already it's own forum. So perhaps just a few posts letting users know about it. I am trying to stay away from pinned topics as they take up so much room on the index. I am thinking of creating a special forum for all pinned topics then putting just one pinned topic at the top of that forum with a link to all pinned topics for that forum. I hope that made sense cause it was hard as hell to think out. :)

Are we going to make this a pinned topic link ?

Nehmer Fast Letter Of Feb 2009

[quote berta] " This Fast letter re-defines how these claims should be handled- it is a stronger statement than the more recent Fast letters on the new AO presumptives and shoul;d be considered in the context of the proposed regs on the 3 new AO disabilities.

Please note one page one of this letter to all VAROS

"ACCOUNTABILITY

Regional Offices must stricly comply with the instructions set forth in this letter and attachments. It is critical that NEHMER claims be handled expeditiously and correctly. The processing of Nehmer claims requires VA to operate under court-imposed deadlines. Failure to comply with instructions could result in court-ordered sanctions against VA and/or VA officials."

I gave the VA plenty of time since my April 2009 AO death award to comply with Nehmer but they failed to.

After contacting the OGC in DC a few weeks ago-from that point on my claim was handled expeditiously. I wanted a decision by Christmas as to the Nehmer court order.A decision was made on Dec 24th 2009 and the monetary award is due to be sent on Jan 4th 2010.The lawyer mentioned in this Fast Letter on page 5 of 14 is the OGC lawyer who took immediate action on my case.

I anticipate my award will be the wrong amount-only because the VA has never in over 10 years sent me a proper monetary award right off the bat. In spite of their sophisticated computers they still manage to add wrong.
But maybe I will be surprised on that.

Nehmer costs the VA lots of $$$$$. In many cases even if a Nehmer vet dies and then his widow or her widower dies- the Nehmer money that was due still has to be paid to the next of kin or estate of the veteran.

There is absolutely no incentive for the VA to attempt to withhold Nehmer Retroactive payments but they have done this and will continue to until- all vet reps and all Nehmer class action members take a stand on getting their proper retro awards.

Nehmer claims are handled in a special way -that is explained in this fast letter attached.

If they arent handled this way- the AO vet or survivor has to take other action as the VARO has committed CUE and also defiance of the mandate of the Nehmer COurt Order.I will certainly explain how that goes if and when we get vets or widows who are owed Nehmer money that the RO failed to pay.We had a few here already at hadit.

If the VA had properly handled my claim and sent it to the PRC in May of 2009 my case would be resolved by now. But I am grateful they again buggered up my claim as I learned of the internal VA AO claims procedure- and would not have known how it worked if they had given me the proper AO award at that time." I believe that is Fast Letter 09-09.

If it is a different letter, I would be interested in posting it in here if it is not already.

Actually, I probably got clues from Berta as well as others in here to find some of these fast letters.

It took some ferreting to find some of these. I KNOW some that were mentioned on hadit allowed me to know what was out there.

The ones who went before helped me a lot as I did these suckers.

If anyone finds new ones, whether newly published or wandering in the ether of the Internet, please let me have them or show me the way. Just because these are posted here doesn't mean I want to stop looking. I've just run out of finding some.

They dont seem to have any actual links there however so that will take time if I find any we still need.

Last time I mentioned a new VA fast letter to a vet rep he just gave me a blank stare.

Reps get notifications of these Fast Letters and Training letters but they all don't read them.

Still looking for the 17 page DMII 1997 Training letter.

Berta,
VBN's list is exactly the same. I did that one too.

This forum is a result of that topic. When I upgrade one, I upgrade the other.

Since I am not computer savvy (like TBIRD is) I had to insert the letters there into one topic using the original post for mentioning what reply was where and on what page.

Just a Reminder to those visiting this forum...

Whenever the words "Work in Progress" is in the heading of the topic, it means the pdf file has not yet been completed. When Tbird and I have the time we will eventually get them completed. Unfortunately it takes a little balancing to each have free time at the same time.

In the meantime, if you need to access any of the Work in Progress topics, all are listed at my topic on VBN. Check the original post of that topic to find the REPLY number along with the page if after Page 1.

http://vets.yuku.com/topic/48610

edit: forgot....The 10-04 Nehmer REVISED September is NOT on this topic but can be found in the same VBN forum as the topic. Just check the VBN VA Policies & Procedures Forum.
sorry about that. (edited Feb. 18, 2011)

Just to let anyone interested know...

I have added some Fast Letters and a VHA Directive to the VBN Training Letter topic. I have not added to here yet.

That is going to be my next project. I hope to get all the Work in Progress with the documents as well as add in the new.

Here is a list of added info on VBN:

TL 10-04 Revised Nehmer

FL 11-15
Handling Disagreements withFinal Decisions by the Board of Veterans' Appeals

FL 11-13
Medical Foster Home(MFH)
Program

FL 11-11
Overview of Changes Made byPublic Law 111-275, the Veterans' Benefits Act of 2010.

VHA Directive 2008-005
Certification Of Clinicians Performing Compensation And Pension Examinations

Thanks 'fanaticbooks'. I salute your dedication. And to all those who contribute to this ongoing effort.

Tbird and I are working on this forum. As of now ALL letters/directives/whatevers are ACTIVE. In other words, The Work in Progress is no longer needed for these since they are done.

We still need to update this Index topic which we will be doing shortly. No time today to complete.

Please look over the forum letters to find your relevant letter.

Will mention in here, when the Index is updated.

:)

This was a really great project idea you came up with
and should help many claimants with their needs.
You are doing an excellent job on this.

Forgot to mention....

The updated Index is now posted in the ANNOUNCEMENTS section not in this topic in which I am writing as of now. lol

Continue to comment concerning this forum or index or whatever in here as needed. We just wanted the Index to be just that without additional replies interfering with people looking for a document.

The work you and Tbird have done is WONDERFUL Fanaticbooks!!!!!

Now all I need to do is take the time to read all this stuff good.

We all need to be familiar with this info and it grows all the time.

I will keep my eye out for the new C & P Memo that has considered CLL and SLL as subsections of NHL and this means that these disabilities will now be added to the NHL AO regs.
I posted the info in our AO forum but this isnt really part of the reps yet and should be ASAP.

Thanks Berta.

You help is greatly appreciated. I can't always catch new stuff and sometimes can't access them either. I need all the eyes out there I can get.

At least with this forum, the document link isn't going to suddenly disappear with no other access to it. I have the document on my personal computer as backup also. :)

I wish all Good Journey and hope it helps.

TL 10-04 Revised Feb. 2011

will eventually be inserted. There are a number of changes in it.

I have listed it in the forum and included a link to the VBN topic of same.

Tbird and I are unable to mesh to get this inserted at this time.

This is just an interim measure until we can.

Thank you.

I haven't had time to work this site, but have made a note. This and Berta's seem worthwhile to post. Will get there eventually.

Thank you again for keeping an eye out for pertinent info.

Unfortunately, I don't have a "current" source for fast letters. I have to rely on searching the Internet, the Texas State, and MAINLY others who bring a letter to my attention.

Anybody having any ideas for a better way of gathering would be a help.

I basically, "wing" it. lol

Thanks to you, Wings, I put a lot on via the Texas State. Found another on that list to put on but no real additions have been added to their list. Didn't have Fl 11-23, but have made note of it.

Will be working on adding to this forum and VBN probably first of next year.

At one time, I recall the VA would issue "fast letters" after the General Counsel issued a Precedent Opinion http://www.va.gov/og...entopinions.asp

I don't have a ready source either ;-)

Stay tuned, this program will return shortly. lol

Thanks to Berta posting in the New OEF/OIF Forum, Fast Letter 11-35 surfaced.

I have copied and will eventually post in here when TBird and I get together.

In the meantime, the letter can be found in the new forum (or on VBN).
