@  Asiadaug : (16 November 2014 - 02:07 AM) Thanks. I Have Seen The Fast Ltr 10-35 And Have Seen Cases Where The Va Has Apparently Agreed That Tinnitus Can Have Delayed Onset. I Did Not In Looking Over The Fast Ltr See Where They Had Ruled 10-028 Into That. And, I Am Not Sure In The Vas Issuance Of ‘policy’ Type Letters How They Might Roll In Previous Instructions Into Newer Ones. Maybe There Is Some Intranet Traceability Capability? I Was Just Curious As There ‘appeared’ To Be Conspicuous Absence Of That 10-028. I Am Assuming 10-028 Was Written In 2010. But It May Be I Should Not Assume Anything.

They could but "usually" they require that the TDIU form be filed, first.

It's probably highly unlikely but as long as you're earning less than about $9k-$10k, annually, you should be okay, as long as you don't hide the fact that you're working part-time. jmo

The newer C&P exams often state that the condition AFFECTS ones ability to work, which doesnt mean it PREVENTS them from working. Do you meet criteria based on percentages? One condition rated at 60% or 2 equaling 70%, with a 40% and 30%? Another criteria is earning less than SGA, which you can find the actual amount on the social security site, its about $11,800 a year. If you qualify VBA may infer and invite IU.

The examiner will fill out the questionnaire and if it prevents working the examiner will write in prevents.

Right now I'm looking at a copy of my C&P exam which is the new DBQ Form. Well actually it's not new, I believe this is the 7th time that they tried using it because they couldn't get all the bugs figured out the first 6 tries>lol.Anyway it reads under the question regarding "Functional Impact" asks does the Veterans condition impact his/hers ability to work. If the examiner checked yes, then it says to describe the impact with one or more examples. On my report the Dr checked yes and wrote "Can only do sedentary work". So that makes me wonder BUZZ if your examiner wrote anything down after he checked yes.

He also wrote , able to preform only sedentary or light physical employment and nothing that would involve frequent neck movements.
He also wrote down for my headaches, due to frequent debillitating headaches, veteran is able to work only part time and feels he will soon be unable to work at all.

Just by the examiner stating this, I doubt very much they will grant TDIU. Unless you file an NOD with a good IMO you fight a better chance of being granted.
