Another update...I called BVA ombudsmen and was told that my appeal, even though it states with VLJ on Ebenefits, has not been assigned a VLJ yet. I was told because I did not request a hearing, that it has to be assigned a Veterans law judge, VLJ. Tic Toc...

Qwiksting, what do you show for recent activity on your Ebenefits appeal screen detail (what are recent dates)? I seem to remember you should have an old docket number that would give your appeal priority

it says"Date of current progress" 5/9/2012, "current progress" With VLJ Docket number is 0940***. It was kind of strange as benefits has it listed with the VLJ, but no VLJ has been assigned yet.

I think BVA does a good job. I would be concerned about AMC.

I always felt better if things were at BVA.....

Yes i agree. First conclusion i came to after reading the remand instructions was another STALL tactic. By the way i looked on ebenefits today and saw that a second DECISION& CLAIMS FILE DISPATCH was there as of 05/18/2012 and in the what have we received at bva column it states CORRESPONDENCE RECIEVED as of 05/18/2012. What is this as i have not submitted any evidence, and the first decision on the remand came on 05/15/2012 and i have already recieved that remand letter from bva. The remand was for the amc to associate my ssa records to the file and readjudicate only. Any idea's anyone?

How long can a claim sit in the "Inbox" for a VLJ to adjudicate? My docket number is 0940****. It has been with the VLJ since 27 April. Every time I call BVA i get the same answer, "it is in the Inbox for the VLJ to get. It has not been looked at yet. Just curious and anxiously waiting to get this done.

ebenefits.
Perhaps pick ONE day out of the week to check it.

Yes, that is correct Dean. I read another post on here earlier, that was about the DAV and how the Service member lived near the VARO and could keep a very watchful eye, and hand carry claims,Nods and appeals to them. He stated he caught them trying to send an NOD to BVA after he asked for a DRO. It sounded so familiar. Guess thats why I am still at the BVA today. I also asked for a DE Novo Review. Never happened.

Once the vlj got my file, even though it was remanded it still once the vlj had it it only took 3 weeks for them to remand it. Hoping the best for you.

A remand is a risk. I read somewhere that BVA percentages are 25% award, 50% remand and 25% denial.

But I am convinced that Hoppy's argument on my behalf was crucial in my getting the award and hope that for you, too.

Well, there seems to be more movement on my appeal. Maybe somebody can chime in..this is what benefits is telling me:
I see they have updated my appeal as of today..6/22/2012 and when I click on download va letters this is what I get...

We are unable to locate records in VA files indicating eligibility for the VA letters that are currently provided in this on-line service. Please call the National Call Center at 1-800-827-1000 if you need additional information.

I also get this for pretty much anything else I click on..VA payment history

Anyone ever have this happen?

Ok, it looks like the Board has made a decision on my case. I called today after looking at Ebenefits. My Ebenefits says:



Your case has been received at BVA, and BVA has mailed your decision to you (and your representative, if any) and will be returning your claims file to the Appeals Management Center or, if represented by an attorney, the Regional Office. Please note that transit times vary, and there may be some lag time between when BVA forwards your claims file to its appropriate location and when that location receives it.

Does this mean it is going to the AMC? The lady I talked to at BVA could not tell me what the decision was.

Yes it looks like it was remanded to amc, usally for more development of appeals.(ie.. c&p exam,medical records, medical opinions etc..). Sorry to say but, this is not where you want your claims. I just had my appeal leave this place today after 2 months at the amc, with 1 of those months file was just collecting dust. But only after having made sure the remanded development was completed to va standards, and verified that development was completed, i submitted a waiver of their considerations and within 3 day's my appeal was out of there, and as of today it is back with the vlj. I DO NOT recommend this at all to every veteran in their appeals , but i felt i had good evidence, and feel these people at the ro level just plain refuse to read and comprehend evidence.

Wait until you receive your letter from bva and take it from there. Also check your letter generator to see if any new letters have posted in your profile, it could also maybe be a partial grant/ remand.

You are right ketchup..I just got off the phone with VA, and from the conversation I had with the woman there, she said something about Hernia, and more evidence...I asked about my GERD and she said once the AMC is done with it , it will go back to BVA. So no decision on anything yet I suppose. Maybe they want me to go to a C&P for the hernia, ( I never got a C&P for my hernia,just a denial from VA). Anyway, all of it is somewhat related to one another. GERD,Esophagitis,ulcer......then another claim for Hiatal Hernia. Both Claims denied, both were NOD and ended up at BVA together. Waiting with anxiety.....
