    • A bit about Tbird and HadIt.com for those who've asked...

      The following is on my About page, but some have been asking how this all happened. So here is my little story. Tbird US Navy 1983 – 1990 E-6 HadIt.com the website domain registered Jan 20, 1997 the domain is registered and paid for through Jan 21, 2023 at which time I plan to register it for another 15 years Lord willing and the creek don't rise. I guess the best place to start is Jan 1991; I had gotten out of the navy Dec 1990. At my separation seminar, there was a DAV rep Jim Milton he told us to bring our medical records in and he would look through them for us and let us know if we should file a claim with the VA. Well, bless his heart, he opened my medical file, reads the first insert, looks me straight in the eye, and says you will be 50% for the rest of your life and he would file the claim for me. 50% was for surgery I had in the service. True to his word he met with me and talked with me for a long time filled out my paper work and urged me to file for PTSD. I would not file the PTSD claim, nor even discuss it. By Feb 1991 I had moved to the San Francisco bay area and was staying at a friends apartment and pretty much I was just a puddle. In desperation one night I called suicide hot line, I had no job, no idea about going to the VA. They talked with me for a long time and explained to me that I could go to the local VA hospital even if I did not have insurance. Now, I know what you are thinking if I was 50% why didn't I just go to the VA in the first place, two reasons 1, this was Feb 1991 and the 50% didn't come till May and 2, even if it had come through it is unlikely that I would have had the mental acuity at the time to put the two together. I relate this here because it is where so many of our brothers and sisters are coming from, perhaps where you started. Fuzzy and unsure, in pain and sometimes homeless they come to the VA hospital for help. And that is where I ended up. Up to the pysch ward I went, blah, blah, blah, a few days later I was released with a promise of a call from the out patient program, which I would soon be entering. Blah, blah, blah, after many missed communications, and no call backs I was at the Day Hospital everyday M-F. And this brothers and sisters is where I began to learn and formulate my plan for HadIt.com. Veterans, veterans everywhere…I spent a year in the day hospital and about another year at a sheltered workshop before I got back on my feet. So I just talked to veterans everyday waiting for appointments, waiting for prescriptions, waiting for a vet rep and I started to learn the system. While in the navy I was data analyst and had to learn a 5 volume manual and just about anything you were suppose to do was in that manual. So I figured there must be a manual on how to do a VA claim or at the very least regulations. So I found out about the Code of Federal Regulations, United States Code, Veterans Affairs Manuals and so on and so forth. Of course this was 1991/1992 I was living in a tiny studio apartment in a particularly bad neighborhood, working in a sheltered workshop making a nickel per envelope I stuffed throw in PTSD and you will see that it was a difficult task for me to get somewhere where they had copies of these, let alone that they would let me look at. And there was so much knowledge around me, it was like the gold rush in those days, I could just sit on a bench a veteran would sit down next to me a little conversation later I had another nugget, I made copious notes. Phone numbers to call, ask for this guy or that guy he'll give you the straight scoop and they'd slip me a piece of paper with a number on it. You want to read this regulation or that one and another slip of paper into my hand. I spent a lot of time on those benches watching the squirrels they gathered their nuts and I gathered mine :) So I'm thinking I could put a little handbook together print it out and hand it out at the VA. Or perhaps fliers. Still formulating, time goes by, 1994/1995 I am being treated for PTSD regularly and doing and feeling much better and I go to work for a company as a marketing systems analyst and I discover the internet. Well let me tell you that was perhaps one of the most significant life changing events I have ever experienced. And I might add finally a positive one :) It seemed only natural to me that surely there must be a website that contained all the knowledge I wanted, well as it turned out not so much, lots of stuff but I wanted to get straight to the claims information and there was a lot of stuff to wade through to get to it. So taking my lesson from the squirrels earlier I started to gather, gather, gather…and learn HTML and work as a marketing systems analyst and work my claim. 1996/1997 major PTSD cork blows and unemployed. Working my claim, working the website. 20 Jan 1997 register HadIt.com domain name right after getting off the phone with the VA and saying I've had it with this. As fate would have it the old DAV board goes down just as mine opens up and folks start to wander in. So HadIt.com has two main components the website which supports the discussion board with links, articles, research resources etc. The website starts to grow, I can't tell you how many times I had to switch servers for space and features. I continue on a downward trend and in 1998 ended up back home in St Louis living in my sisters basement in therapy and working it, I swear I would have swung a dead chicken around my head at midnight naked if I thought it would have helped. The website continued to do great during this time, I just stayed in the basement bought new software, new books, and learned how to make things work and I continued to use this knowledge to make HadIt.com better. My 100% finally came through from the VA and I had a friend who is an advocate who helped me thru my SSDI claim, he was literally at my side thru the entire process and that came through for me. My therapist and sister continued to try and get me to leave the basement, but to no avail. At some point in 1998 or 1999 I put a counter on the website and was shocked to discover how many visitors we were getting. Time goes by my sister gets married and I move from the basement to the upstairs, there is much celebration that Aunt T is living in the light again. More time goes by and I settle into my life in St Louis and spend more time on the site trying new things, finding more information. 2003 I buy my own home VA loan. For years now I have just considered HadIt.com my job and I get up every morning go to the office and work for several hours, take an afternoon break and see where the rest of day takes me. I have a place in the office to use the computer and a comfortable to place to read journals and articles and take notes. Blah, blah, blah so that is my story and HadIt.com's intertwined.

Tdiu Deferred

Hello to All,

Today I received the award letter...70% rating and TDIU deferred. There is very little information in the letter as to what they need from me. I know that they need the TDIU form from info. gathered from here and other researching, but it was not included, nor mentioned. There are two sections where the IU is noted in the letter. Under "What We Decided," it states: "we have deferred a decision on the following issue because we need additional information or evidence: Individual unemployability"

Under "REASONS FOR DECISION," there are two sections:

"1. Service connection for Acquired psychiatric condition claimed as posttraumatic stress disorder (PTSD) and depression." This section then goes into the evidence, etc, and reason for the decision.

"2. Entitlement to individual unemployability." In that section it states:

"The evidence shows that you have not worked for several years, therefore individual unemployability is being inferred. The examiner did not state that your PTSD caused total occupational or social impairment at this time."

Nowhere in the letter is there anything noting what additional information or evidence they need. I don't see how the examiner could have made a note of total occupational when she did not ask about that. She did ask me when I last worked, but that would not necessarily mean that I would be unemployable if she does not know or consider? After getting home from the exam, I realized that I did not make note that I was awarded SSDI many years ago, but it's in the VA record which she could make note of in her review of the file and I know that VARO already has the SSA records.The social impairment issue they state is not exact and is all over my medical records because I have severe impairment of that, also. So, I'm not in total understanding of what is it they are looking for, or maybe I'm just missing something. I am aware that SSA decisions and VA are separate, but it was for the same issue.

Can someone please help me decipher what I need to do to get this going besides completing and submitting the TDIU form which I am going to do by the end of the week. There is no way that I can remember that far back for employment times, so am going to go to SSA and see if they have my work history available, so I can have at least an estimated timeframe for the completion of the TDIU form. Thank you for any thoughts, advice, or response.

I am no expert here, but I would think that if the VA inferred the TDIU, that you definitely need to submit the application for it. My BIG concern here is the earliest effective date. If the VA inferred from the current award claim date (when you opened the claim), then I would like for you to be able to get the 100% retro from the date of the claim, not from the day you signed the TDIU application (like by the end of the week).

They may have inferred TDIU, but I don't have any confidence that they will 'infer' paying your more than you ask for. They will use the application signed date and pay you from there. Others will have more info than me, but my husband's claim is similar, and they requested he submit a TDIU application (which had already been submitted). I felt like there were trying to trick him into signing a new app with a much more current date, and then screw him out of 2 years of retro. So, I resubmitted the application with the original date, highlighted the original date a million ways, and sent along a note telling them that the repeated request for the same information was not due process and proof that they had already received it multiple times just to keep the record straight. I think they play these games, claiming to need more (or the same) info, just to shorten your earliest effective date, jmho.

Thank you westcoastlv for your response. That's what I'm afraid of...that they will play around with the EED if they approve TDIU because the original application didn't include it, but I found several court cases that may go against that attempt. I made it over to SSA today for a print out of work history, so that will give me enough to jog my memory for the required employment questions on the form. Again, thank you so much and I hope great success for your spouse with his TDIU claim.

Well after being awarded an increase for PTSD in May, the TDIU was deferred. Now, many months later, and after checking Ebenefits yesterday only to be told that 'no information can be found on you claim', I checked it again just now. The claim has gone from Gathering of Evidence to Preparation for Notification. Of course, don't know if that's good or bad because Ebenefits is revealing nothing. The Benefits Explorer still shows the same, as well as the Benefit Letter. So, I guess we'll just have to wait until the claim shows closed. Last time this happened, we got a letter form the VSO telling us of the increase well before it showed up on Ebenefits.

Don't know how long Prep for Notification takes, but will keep watching and praying my vet gets his well deserved 100% whether by award or granted TDIU.

Now the anxiety begins because a decision has been made, we just don't know what it is. :)

The VA does tend to stick with the date you submitted the TDIU form even if it was well before your latest increase as long as the claim was still in appeals. I submitted a TDIU claim when I was 30%. That was the date they used when I got bumped up to 70% on appeal. Sometimes you can use a hospital admission to get EED on a TDIU claim. I did after asking for my TDIU to be the same as my SSDI award date. If a vet is on SSDI for a SC condition the VA should infer TDIU. They won't unless you claim it, however. They always want to cheat on the effective dates right down to the date of your C&P or the latest piece of evidence you submitted to them.

EthansGrandma my tdiu was deferred back in 2008 and invited to file a claim did so and finally recieved TDIU P&T this past Aug 30th so am hoping good news for you likewise and great you are aware of the eed best of wishes

Thank you all for the responses. Now, I have new question that I hope someone can help with. I gathered my info., employment history, etc., and submitted to VA with the TDIU form. This past week I received a VCAA notice that appears to include the TDIU as a "new" claim, along with other pending claims that had been in the system which appear to just now starting to be developed. The TDIU was deferred in their decision which seemed to be awaiting further development, so I'm not understanding why it's being listed as "new." In the past, the VA has separated my claims, so I'm lost as to why they commingled the TDIU with the other claims. Is this protocol for them to handle a deferred decision in this way? I would have thought they would get to their "end product" with the deferred decision. This really concerns me because the decided claim took seven years to get to a rating with evidence that was already of record (claim never went to BVA), so is the prospect another delay in decision just because? Thank you all for any input!!

I applied and I was not inferred for IU, but I'm at 70%, met the criteria, can't work at previous work with my condition and have pending contentions. They combined all my contentions as they did yours and C&P'ed me on the three contensions already awarded that had C&P's within the last 15 months. Then they used one of those C&P's to deny a NOD on a claim for feet problems stemming from that approved condition. Strange thing is the C&P examiner stated the exam was for IU, examined one foot for the IU calim and never looked at the other foot at all. Soooo, one would ask how could the NOD be denied when both feet were not examined?

As you have probably read, an IU calim opens up everything to re-eval so good luck. Don't think I answered your question, but shared my experience so you may better understand this confusing process.
