    • A bit about Tbird and HadIt.com for those who've asked...

      The following is on my About page, but some have been asking how this all happened. So here is my little story. Tbird US Navy 1983 – 1990 E-6 HadIt.com the website domain registered Jan 20, 1997 the domain is registered and paid for through Jan 21, 2023 at which time I plan to register it for another 15 years Lord willing and the creek don't rise. I guess the best place to start is Jan 1991; I had gotten out of the navy Dec 1990. At my separation seminar, there was a DAV rep Jim Milton he told us to bring our medical records in and he would look through them for us and let us know if we should file a claim with the VA. Well, bless his heart, he opened my medical file, reads the first insert, looks me straight in the eye, and says you will be 50% for the rest of your life and he would file the claim for me. 50% was for surgery I had in the service. True to his word he met with me and talked with me for a long time filled out my paper work and urged me to file for PTSD. I would not file the PTSD claim, nor even discuss it. By Feb 1991 I had moved to the San Francisco bay area and was staying at a friends apartment and pretty much I was just a puddle. In desperation one night I called suicide hot line, I had no job, no idea about going to the VA. They talked with me for a long time and explained to me that I could go to the local VA hospital even if I did not have insurance. Now, I know what you are thinking if I was 50% why didn't I just go to the VA in the first place, two reasons 1, this was Feb 1991 and the 50% didn't come till May and 2, even if it had come through it is unlikely that I would have had the mental acuity at the time to put the two together. I relate this here because it is where so many of our brothers and sisters are coming from, perhaps where you started. Fuzzy and unsure, in pain and sometimes homeless they come to the VA hospital for help. And that is where I ended up. Up to the pysch ward I went, blah, blah, blah, a few days later I was released with a promise of a call from the out patient program, which I would soon be entering. Blah, blah, blah, after many missed communications, and no call backs I was at the Day Hospital everyday M-F. And this brothers and sisters is where I began to learn and formulate my plan for HadIt.com. Veterans, veterans everywhere…I spent a year in the day hospital and about another year at a sheltered workshop before I got back on my feet. So I just talked to veterans everyday waiting for appointments, waiting for prescriptions, waiting for a vet rep and I started to learn the system. While in the navy I was data analyst and had to learn a 5 volume manual and just about anything you were suppose to do was in that manual. So I figured there must be a manual on how to do a VA claim or at the very least regulations. So I found out about the Code of Federal Regulations, United States Code, Veterans Affairs Manuals and so on and so forth. Of course this was 1991/1992 I was living in a tiny studio apartment in a particularly bad neighborhood, working in a sheltered workshop making a nickel per envelope I stuffed throw in PTSD and you will see that it was a difficult task for me to get somewhere where they had copies of these, let alone that they would let me look at. And there was so much knowledge around me, it was like the gold rush in those days, I could just sit on a bench a veteran would sit down next to me a little conversation later I had another nugget, I made copious notes. Phone numbers to call, ask for this guy or that guy he'll give you the straight scoop and they'd slip me a piece of paper with a number on it. You want to read this regulation or that one and another slip of paper into my hand. I spent a lot of time on those benches watching the squirrels they gathered their nuts and I gathered mine :) So I'm thinking I could put a little handbook together print it out and hand it out at the VA. Or perhaps fliers. Still formulating, time goes by, 1994/1995 I am being treated for PTSD regularly and doing and feeling much better and I go to work for a company as a marketing systems analyst and I discover the internet. Well let me tell you that was perhaps one of the most significant life changing events I have ever experienced. And I might add finally a positive one :) It seemed only natural to me that surely there must be a website that contained all the knowledge I wanted, well as it turned out not so much, lots of stuff but I wanted to get straight to the claims information and there was a lot of stuff to wade through to get to it. So taking my lesson from the squirrels earlier I started to gather, gather, gather…and learn HTML and work as a marketing systems analyst and work my claim. 1996/1997 major PTSD cork blows and unemployed. Working my claim, working the website. 20 Jan 1997 register HadIt.com domain name right after getting off the phone with the VA and saying I've had it with this. As fate would have it the old DAV board goes down just as mine opens up and folks start to wander in. So HadIt.com has two main components the website which supports the discussion board with links, articles, research resources etc. The website starts to grow, I can't tell you how many times I had to switch servers for space and features. I continue on a downward trend and in 1998 ended up back home in St Louis living in my sisters basement in therapy and working it, I swear I would have swung a dead chicken around my head at midnight naked if I thought it would have helped. The website continued to do great during this time, I just stayed in the basement bought new software, new books, and learned how to make things work and I continued to use this knowledge to make HadIt.com better. My 100% finally came through from the VA and I had a friend who is an advocate who helped me thru my SSDI claim, he was literally at my side thru the entire process and that came through for me. My therapist and sister continued to try and get me to leave the basement, but to no avail. At some point in 1998 or 1999 I put a counter on the website and was shocked to discover how many visitors we were getting. Time goes by my sister gets married and I move from the basement to the upstairs, there is much celebration that Aunt T is living in the light again. More time goes by and I settle into my life in St Louis and spend more time on the site trying new things, finding more information. 2003 I buy my own home VA loan. For years now I have just considered HadIt.com my job and I get up every morning go to the office and work for several hours, take an afternoon break and see where the rest of day takes me. I have a place in the office to use the computer and a comfortable to place to read journals and articles and take notes. Blah, blah, blah so that is my story and HadIt.com's intertwined.

5103 Waiver Overdue From 3Rd Party

I checked my ebenefits account yesterday and saw that under my gathering evidence for my claim folder the VA has a note in there saying that a 5103 waiver from a 3rd party is overdue. The due date was Aug 5, 2013. Does anyone know what this might be? Would the 800 people or IRIS be able to tell me who this 3rd party might be?

In all fairness to Megh, as I know she is a service officer, and we have talked, it's not quite what she thinks and there is way more involved than people realize. So here goes. If I loose you, I applogize, hopefully we can work through this as this 5103 waiver isnew to the VA, as well as new to the Veterans.

eBenefits pulls it's information from the VBMS (Veteran's Benefits Management system - paperless system) claims processing program. In that program there are what we at VA call suspense reasons.

"suspense reasons" are snippets of explainations of what the VSR or RVSR or Coach or claims assistant,or finance, or authorization, (in other words any one having someting to do with your claim) may have for a reason to "suspend" or is "waiting " for something for som reason or another. For example.....

You file a claim, and you send in a VA FORM 21-4142, Authorizing VA to get medical records from Dr. Smith. We now have a contractor who gets the Veterans private records. So the form goes to the Contractor (DOMA), but the VA puts a "suspense" in the system that says, awaiting 3rd party information. Yor records from your doctor are considered third party. The suspense reason has a space to enter an expected date when the VA should have received the information back from DOMA. Usually the suspense is for 7, 15, 30, 60 or 90 days.

Lately everything has been about 15 days, VA is pushing to get responses within 2 weeks. When that date comes we check the system (through a program called VOR- it's a search spreadsheet system) to see if we got Dr. Smith's records. If VBMS shows we did get the records then we move the case to the next step toward making a decision, if we didn't get the records we do supplemental development, we call the doctor, we email a supervisior who's job it is to kick the contractor (DOMA) in the butt to get the records and we update for another 15 days. This goes on in one form or another for all claims and all issues. Certain claimed issues require different supplemental development. (simply as we request records or inforamtion we put in suspense REASONS and as we receive the information requested we indicate RECEIVED.) We can have many, many different request working at one time depending on the issues claimed and the evidence needed or requested.

I am going to take this one step further. The new 5103 waiver is the name for the old VCAA letter. The newer forms of 21-526 are now 21-526ez forms. and for NSC pension are 21-527EZ form. These forms contain what are called WTEMS. WTEMS is an acronym for "what the evidence must show". These are paragraphs of information that the VA MUST provide to the Veteran to aid the Veteran is his claim. There are WTEMS for direct service, seccondary, increase, N&M, A&A, Pension, IU, SMC, and on and on. WTEMS ARE the duty to assist portion of the %!)# or the OLD VCAA letter attachemnts.

In eBenefits, the phrase " 5103" simply means the application YOU USED for YOUR claim had the standard 3 WTEMS. The standard 3 WTEMS are what the evidence must show for, service connected conpensation, service connection for a secondary, and service connection for an increase. It simply states what type of evidence is needed for each type of claim. The 5103 VA Forms 21-526EZ and 527EZ have the WTEMS built into them in the application, READ THE FINE PRINT in your compensation application about evidence.

This notice in ebenfits that states.... 5103 notice or 5103 waiver simply means you have signed either manually or electronically the 5103 Notice that you have been advised of your rights, per the 5103 waiver when you sign your application.

When the VSR or RVSR looks in the computer and we see 5103, it tells the VSR or RVSR we DO NOT HAVE TO SEND YOU A LETTER ANYMORE to tell you what we are doing on your claim if you file one or more of the BIG THREE types f claims. (remember increase, secondary or direct) as you got the evidence requirements on the applictions and you signed the waiver stating you got the imformatin.

I know this is complicated, but it is important you realize the VA Form 21-526 EZ and 527EZ forms are telling you what is needed in support of your claim.

Please ask any questions you have on this as I know it is new and it's taking VA a bit to adjust to the chage as well.

I got the same status in eBenefits and know that my VSO forwarded the 5103 waiver form to the RO at the end of July. At the 30 day due date for the 5103 waiver form in the middle of August, eBenefits started showing that this document was overdue. My guess has been that no one in the RO, other than whomever did data entry (twice, once into the old system then once into VBMS a month later), has actually touched my claim since the 5103 waiver was generated somewhere else within the VA hierarchy. And that's the assumption I've made again today seeing the same status and no movement on my 4 1/2 month old claim at all -- because the RO where my claim rests is in the midst of trying to solve some older and more challenging claims with heat from the top to clear those claims a year older or more. The claim was supposed to be submitted either on line via eBenefits or locally through the RO. Am I making a bad assumption?

According to the Fast Letter describing the 5103 waiver process, it seems as if some entity above the local RO makes a decision based on what it sees within VBMS or some other system that my claim, like many others, can be decided quickly if I certify that I have nothing else to submit.

So what you're saying is that the 5103 waiver system looks at the WTEMS, decides off the cuff that based on the claim being an FDC-style claim that all the pieces are there to make the decision, then generates a decision that if the veteran certifies that there is nothing else that could bear on the decision, the VA will move the claim along as expeditiously as possible? Have I got that right?

Is this in lieu of the old VCAA response form?

The one we were supposed to sign and mail back to the VA?

I never got one. The BVA said I mitigated the prejudicial damage of the illegal VCAA letter I got (it was all snafued) because I had probative evidence anyhow.

The VARO said I had failed to respond to the response form they did not send me.

I could not get my former reps (to include their director here in NY) to support my contention that my VCAA letter was illegal and prejudicial.

I filed a complaint with the OGC against my reps on that long story with Very good results,

but it appears to me here that TiredCoastie digested all this quite well:

Let me see if I have this right:

Yes that is correct. Coporate offices (D.C.) decided they wanted call the VA's duty to assist 5103 after the number of the legislation instead of VCAA.

NO- - The VCAA response form and the 5103 response form are still part of the process and the forms are exactly alike ...the response form used to say at the top of the form:

VCAA Notification Response .... now the form says

5103 Notification Response

other than that the form is the same as before.

The VARO said I had failed to respond to the response form they did not send me.

I could not get my former reps (to include their director here in NY) to support my contention that my VCAA letter was illegal and prejudicial.

The fact that VA said day you failed to respond to the VCAA letter by sending in the response form is BOGUS. We decide claims every day whether the form is returned or not. The fact is, VA really doesn't care if you return the form, because afer thirty days if they don't get the form saying you need more time for submitting evidence, the VA is free to continue to move toward making a rating decision. The only time it really matters is if the Veteran is waiting for private records or a private report or something very detrimental to the claim. The the VBA tries to wait until all the evidence the Vet has to send is recevied. so by the Veteran sending in the form it bides more time. Claims processing have been SO SLOW the Veteran doesn't need to ask for more time. Other than what I have explained here returning the form or not really doesn't have much bearing on the claim. So I think they fed you a line just to get thier butts off the hook for unfairly processing your claim.

Oh also, by signing the response form and returning it to the VBA, it shows we have a current address and you recevied your mail. The VCAA letter is a different matter than the VCAA Reply Notice.

Well, sorta. - Every claim is entitled to the 5103 Duty to Assist information. The big wigs, in D.C. at the Coporate level, decided VBA spend entirely too much time writing VCAA letters every time a Veteran submitted and claim, and then submitted more claims, and more claims. Each time VBA had to stop the decision process and send out another VCAA letter tellng the Vetern what was needed in support of the claim.

The previous VCAA letter USED to list the conditions currently claimed, and the newly claimed conditions, and then provide the WTEM ENCLOSURES and the VACC response Notice in each letter everytime a Veteran claimed a new condition while a clai was open and not yet decided. Everytime a veteran sent in a new claim this would have to be done. It slowed the claims process down a minium of 60 to 90 days depending on if VA had to obtain more records for the new condition.

SOOOO, the corporate offices felt the Veteran was getting the same information over and over and the Veteran knew what he claimed and we didn't need to tell him that again and this old way of VCAA was redundant and slowed the process down to a crawl.

sooooo, Corportate decided to change the VCAA process to speed things up and to stop sending multiple VCAA letters to the Veteran A decision was made to change the name of these notifications letters to the Veteran. These letters are officially called the "VETERANS SECTION 5103 NOTICE" instead of VCAA.

The 5103 notice has the body of the letter, requesting service records and private records and specialty claims information and then the WTEMS enclosures as well as the 5103 Return Notice.

When the new 5103 notification letters were started, new criteria was also implemented on when and how often these letters would be sent out. Also the VA changed the 21-526 and 527 and made them EZ forms. Thiese forms are now used for ALL claims, original, increase, and secondary claims, and the Duty to Assist known as 5103 WTEMS (formerly known as VCAA letter with enlosures). The enclosures also called WTEMS are actually the required by law Duty to Assist requirement according the the legislation that past , what we all use to call VCAA letter and notification.

So the decision was made to include the Duty to Assist information on the claim form itself. We do not send a letter any more once a claim is received on one of these forms if the claim is for direct service connection, increase service connection or for secondary service connection. The claim form itself is considered Duty to assist.

Once a claim is open, and the Veteran wants to add to his claim more conditions/contensions, he will not received a letter from the VA unless a couple things happen. One is he is filing a claim that needs New and material evidence. Then VA sends a letter with N&M WTEMS and also tells the Veteran when his claim was denied and why and what is needed to get the denied claim reopend. As you know this is for claims denied more than one year or not repoened within a year of the decision. Or the veteran is filing a claim for conditions other than the trifecta, (new,increase, secondary). Like IOU, SMC, loss of use, A%A, SAH/SHA/ auto grant. Also claims for special issues like AO, Radiation, GW Syndrome, and others will need a new letter. But the 5103 will not list all the claimed condtiions any more. They are only concerned you receive the enclosures calledWTEMS.

And that this is solely regarding FDCs????????????????????

FDC is a growing and very favorable program. This program requires the Veteran to certify he hs no other evidence to submit right at the start of the claim. VA can then just do their part getting the federal records or any exams and rate the case. Quick and easy, if the Veteran sends in more evidence or adds more conditions to his claim then his claim is excluded from the FDC program. The 21-526 and 527 have a check box the Veteran can check which will exclude himself from FDC program simply by checking the check box on the EZ form. But the EZ form still gave the Veteran his Duty to Assist WTEMS right on the EZ FORM.

Is that fast letter here at hadit?

I am not sure. But I can get a copy of the 5103 fast letters and get them to T-bird. There have been a couple of 5103 letters that hae been desiminated in the change fom VCAA to 5103.

I would like to add a couple of things.

Dont' get the Veterans Section 5103 Notice confused with the VBMS computer software program.

1. Veteran Section 5103 Notice is still the converted VCAA due process notice, required by the Veterans Claims Assitance Act. The 5103 is a modification of how we perform the Duty to Assist Veterans in the claims process.

2. VBMS is the (new) software program that VA is using to covert to the paperless system

3. eBenefits is the new software program written exclusively for Veteran which pulls claims information from the new software program VBMS and I have been told some information from the older VA programs called MAPD, SHARE, VETSNET on a limited basis.

4. The messages seen by the Veterans in eBenefits, are "tracking items" for their pending claims that are found in the VBMS and other programs. Tracking suspense dates and reasons stated in the eBenefits lets the VA employees and the Veterans know what is happening with each claim.

I will try to post a list of the various tracking items that we use so you can see how many different issues that could be involved.

When a Veteran sees "VBMS" in his VA EBenefits screen, the term "VBMS" is a holding place in the program, to show that this Veteran's claim is scanned and being tracked in the NEW program. This does not mean his entire claims file is in eBenefits. It could be some or all.

Seeing this listed in the claim section is NOT a claim for VBMS. It comes at the bottom of the list of claimed conditions and it is a "system " place holder.

When the Veteran's see 5103 waiver in eBeneftis, it simply means the recevied the WTEMS paragraphs (What The Evidence Must Show) for the claims for direct S/C, increase S/C, and secondary S/C. Either through he EZ application or through a letter format.

If these WTEMS cover all the claims the Veteran claimed, then the veteran will NOT get a 5103 letter. If the Veteran has conditions that are more than the trifecta (3) usual (direct increase secondart), he will get 5103 letter with more WTEMS and Special Issues paragraphs.

Important: claims are being processed out of two different programs right now. Some of you will get correspondance from the MAPD program which has been used for the past 7 or so years. And some of you will get correspondance from the VBMS paperless program. You will still be mailed letters thorugh the US postal service no matter which system is used.

EBenefits, pulls some information from both programs. It will be a while before you can count on ebenefits be accurate, unless your cliam is processed 100% in VBMS.

The letter in the old system looks better and the old system letter can be editied. The letter in the new system VBMS do no have an edit function and the letter auto populates by the VSR/RVSR clicking pre formed sentences and paragraphs. (it's not a very pretty letter). Hopefully, it will improve soon.

I hope this helps clarify and separates these issues a bit, as I think people can get them confused with one another.- Harleyman

My claim appears now the be delayed waiting for the "5103 Waiver Review from third party" according to eBenefits, the rest of my claim has progressed and should now be ready for a decision, here is what I believe the real problem is and I have not seen this discussed. Somewhere someone posted a VA document explaining the 5103 Waiver Review process, it discuses that this is a one time initiative affecting about 180,000 pending claims. When you read the entire document you will find that the VA RO is required to forward the ENTIRE claims folder to the scanning facility to be scanned into the new system (VBMS). All the affected claimants were sent the 5103 waiver notice form. Lots of people like my self watched our claim times jump significantly once the scanning center (Janesville WI) was involved in the loop.

I confirmed my files were sent to WI by my RO several months ago, I now believe the delay is the actual scanning of these files the RO's have sent. Remember if you received a 5103 notice that means your entire VA paper file for all your claims has been sent to be scanned in, it makes me wonder at this point have they lost some files in the process, or are they just that overwhelmed and backlogged trying to scan all these files into the new VBMS system?

The reason it is indicating "3rd Party" is that the scanning centers are government contractors not actual VA employees.

One of my clues to figuring this out, is that I had surgery back in August and I filed a Hardship request to at least speed up my temporary 100% rating for the recovery time. The RO agreed and thought they could do this, I brought them all the necessary paperwork, but found out there was no copies of my file at the RO, after giving them all the paperwork, eBenefits indicated they still needed proof of my original Service Connected Disability, which was related to the surgery. I scratched my head thinking they have my file they should know this already, now I realize all my old paperwork and files were sent to this 3rd party scanning center and no one has seen them since.

I am not sure if it will help me or not, but tonight I scanned in my old award letters and uploaded them to eBenefits under the claim for the surgery, tomorrow I should know something, everything I have scanned in and uploaded to date has been acknowledged and updated in eBenefits the same day.

This really needs to be looked into further by someone who knows how to contact the right people at the VA.

I am in "gathering evidence" stage for about 5 months. I also have a "Waiting for 5103 Waiver Review" entry in Ebenefits . I called the VARO and asked them was the VA waiting for me to send in some information or a form. They said "NO, we just have a lot of claims". I informed the VA when I filed my claim that all my records were at the VA hospital in Tampa. I am filing for an increase in my DMII rating. It is pretty simple I think. I had to start taking oral meds to help control my glucose levels. I still do not understand what is happening with this claim.

john999 you are in the same boat as me, your VA Claims records have all been sent to the 3rd party contractors scanning facility, the VA no longer has any of your records and no decision can be made until your files are scanned into the new VBMS system.

I could understand that scanning 180,000 VA Claim folders into the new system could take some time, but it is scary to think that the RO's are sending out our complete folders to these 3rd parties without keeping copies, the chances of something getting lost or misplaced is very high I would believe.

My records may be at the CAVC right now since I have a hearing on Wednesday of this week. I also worry about lost C-Files which is why I have a copy. The idea that 40 years of claims and evidence is floating around between D.C. and my RO storage facility will keep you up at night. It is all on paper which can and has burned in the past. When I got my copy of my File it was a complete mess. When my lawyer got his copy he was used to SSD where it is all neat and in order. VA is about 50 years behind times in every way including compensation rates.

My FDC is at Review of evidence and has been for 4 months. It also shows 5103 is overdue, so I called. The 5103 has been added and if I look at Evidence recieved it shows they have it too.

I am waitng for the Preparation for Decision phase to kick in now.

Do I read this right? All required evidence is there to move my case forward. Sounds like a rare positive note to me.

Thanks for the update W4LNY. All you said makes sense now. VA sense that is....... All the paperwork I have received lately has been coming from Janesville. I guess we all have to just "hurry up and wait". Somethings just never change.
