I spoke with a veteran last week that had a decision in which it was clear that the RO did not either read, or simply chose not to take into account the VA Examiners DBQ’s. The Examiner offered opinions and selected the multiple choice boxes that were quite clearly and indisputably in the veterans favor.
Without a doubt this veteran met the maximum rating criteria per each issue as listed in the VASRD.
I am sure if the veteran pursues this as an appeal, it is a sure win. Sadly, veterans both young and old don’t always outlive the appeals process. The VA should fire all of the rating officials and replace them with DRO’S.
